The Court's opinion provides roadmap to applicants seeking to demonstrate reformation to establish current character and fitness to practice law. And confirms that applicants are not forever judged by their mistakes; that one's past does not dictate one's future #baradmission
An alternative pathway to the bar is approved: the Oregon Supreme Court made it official. In Oregon, starting May 15, 2024 law grads can participate in a Supervised Practice Portfolio Examination to earn their licence to practice in the state.

The dissent is lengthy and would have reversed, holding that lawyer's "knowing, egregious, and substantive licensure problems precluded him from qualifying as counsel in these proceedings." https://t.co/E7wYcEkizm #buchalterethics
In 5-4 decision today, Washington Supreme Court holds that that a lawyer not licensed in WA still provided constitutionally effective counsel for purposes of 6th Amendment to defendants in WA https://t.co/E7wYcEkizm #buchalterethics
Court was not dealing with whether the lawyer should receive further punishment. Instead, the court analyzed whether the lawyer's conduct "resulted in a complete denial of counsel." Court said no. https://t.co/E7wYcEkizm #buchalterethics
OR Court of Appeals issued opinion yesterday that (1) discussed when attorney fees may be claimed as an ascertainable loss under the UTPA, (2) when a tortious interference claim may be based on a violation of the RPCs (i.e., ethics rules) https://t.co/7OlLriDCiH #buchalterethics

Fraud on lwyr trust acts is on the rise. See this recent op from the OR Bar re whether lwyr may deposit own funds into LTA after 3d-party theft or identity fraud to safeguard funds in LTA or to disburse funds promptly upon clients’ request https://t.co/ijLc7M6Q83 #buchalterethics

@bsfaughnan That's true that law firms routinely provide audit responses but that is a pretty specific category and the ABA has developed guidelines for those. Given the lack of ethics ops or cases in Oregon (or the ABA per the article), I think "little used" is pretty fair.
See this article discussing RPC 2.3, a little used rule that "permits a lawyer to offer 'evaluations' to third persons—typically at a client’s request." There are no ethics ops or cases in OR discussing the rule, or its predecessor DR 7-101(D). #legalethics#buchalterethics
