IS A NEW TENANT EXPECTED TO PAY THE OLD TENANT'S ELECTRICITY DEBT?

A new tenant is not automatically liable for electricity consumed by someone else. The person who used the electricity is the one responsible for paying for it—not the innocent tenant who moved in later.

Section 115 (4) of the Nigerian Electricity Act 2023 states that: A new tenant or landlord cannot be held responsible for the outstanding electricity bills of a previous occupant. The distribution licensee must recover the debt from the former landlord or tenant, not from the new occupant.

Rule 29 (3) of the NERC Customer Protection Regulations 2023 states that an electricity bill debt cannot be transferred to a new customer occupying a premises. The responsibility for recovering the debt lies with the electricity distribution company (DisCo), which must pursue the previous customer who moved out.

If a Distribution Company or landlord attempts to force a new tenant to settle an old debt simply because they now occupy the premises, the new tenant can challenge the demand and require the debt to be pursued against the actual debtor, subject to the facts of the case.

Before moving into any apartment:
* Ask to see the last electricity bill.
* Record the meter reading on the day you take possession.
* Inform the electricity distribution company that you are the new occupant.
* Keep your tenancy agreement and payment receipts.

A new customer moving into a property is not liable for any debt left by a previous resident.
