Senior Supreme Court Advocate Shadan Farasat, who was dragged by Delhi Police during last week's protests, has described the situation in the national capital as an “undeclared de facto emergency.”
Speaking exclusively to Nidhi Razdan(@Nidhi) on DeKoder, Farasat questioned the Delhi Police crackdown on protesters, students, journalists and lawyers amid demonstrations against the Election Commission of India (ECI), Chief Election Commissioner Gyanesh Kumar and the SIR electoral roll revision.
Farasat said the Supreme Court is now facing a crucial test, arguing that general orders are no longer enough to protect citizens' constitutional rights. He warned of growing public distrust in the judiciary's willingness to hold the government accountable.
On the removal of Jantar Mantar as a designated protest site, Farasat questioned its constitutional validity, citing an earlier Supreme Court judgment and suggesting the decision could be challenged in court.
Recounting how police allegedly threw him into a moving bus, he also questioned the legal basis of detentions and accused Delhi Police of behaving like the “private army of the ruling party.”
Is Delhi witnessing an undeclared emergency? Is the right to peaceful protest under threat? And will the Supreme Court step in?
