The 'agreed on' cost cap penalty was an insult to sporting fairness. It was levied on a lower amount than the actual breach because of a 'notional' (i.e fictitious) tax credit.
The FIA steered the resolution to an Accepted Breach Agreement (ABA) to retain control of the penalty without it having to be referred to the Cost Cap Adjudication Panel, who had the power to impose stricter penalties.
The only parties that 'agreed' the penalty were FIA & Red Bull Racing.
Red Bull Racing never 'agreed' that they had actually breached the cost cap, retaining their plea that the rules were changed mid season and their original claim of being under the cost cap was correct. The condition of an ABA is that the team agreed that they had breached the cost cap. RBR reluctantly & temporarily agreed specifically to accept the lenient penalty.
The wind tunnel reduction 'penalty' had no impact on the 2021 season in which the cost cap was breached. It had no impact of the 2022 season. The penalty was served incrementally over the 2023 season, being fully served by the start of the 2024 season.
That is NOT a suitable penalty as advantage was locked in for 3 seasons.

The rules were broken, the contest was manipulated, the result was illegal, by the Regs.
The FIA then lied. They released a carefully worded piece of information to fool people into saying exactly that.
If it was illegal... blah blah.
But it was. 100%.
The Race Director has NEVER had the authority to partially apply the written regulations. Once the unlapping clause was invoked it was mandatory to keep the safery car out until the end of the lap AFTER lapped cars were released.
This was confirmed by the trusted experts on regulation interpretation, the International Court of Appeal (ICA).
