Australia originally joined the F-35 Joint Strike Fighter program as a Level 3 partner in 2002, contributing approximately US$144 million to enter the System Design and Development (SDD) phase which then gave Australian industry the opportunity to compete for global supply chain contracts on a best-value basis. It’s also worth remembering that F35s can’t stay in the air without software updates from, and information exchange with, the US.
Like AUKUS, Australia’s entry into the F-35 Joint Strike Fighter program was a political decision about the nation’s defence requirements. For any country with a Westminster system of government, this is a policy matter for the legislature and per se not subject to oversight by any court.
Why is this a problem?
Our main AUKUS partner (the US) is a belligerent, authoritarian regime run by the least competent, least qualified and most unscrupulous administration under the most mendacious and mercurial president in US history. It has supported and facilitated the genocide in Gaza, and is implementing a more integrated defence-technology and industrial partnership with Israel, a flagrant violator of international law. It simply ignores international law when it is an impediment to anything it wants to do, even when those things transgress domestic and international laws and common morality.
It is actively trying to bypass the UN Security Council with its Orwellian ‘Board of Peace’ in Gaza and consistently tries to subvert the judges and prosecutors of the ICJ and UN rapporteurs.
In the event that Australian supplied parts, components or technologies make their way into military assets used in breaches of international law and international humanitarian law, our Australian courts may find – as they did in the UK – that they are unable to interfere with government policy relating to the country’s national defence, not being empowered to transgress on the recognised division of powers between the courts and the legislature. That’s the overriding legal principle about the division of the executive and legislative functions.
The F-35 program is an example of how the Government chose to forsake its obligations under international law because it is constrained in its ability to implement them by its role as a partner nation in the F-35 JSF program. What it means to be a principled and humane international actor has been tested by the F-35 program. By preferring the program over international legal obligations and acquiescing in the use of F35s to bomb innocent men, women and children in Gaza our governments have failed. AUKUS will be no different.'
