AAP’s favourite defence was: “There was no paper leak in Punjab.”

Now the Punjab & Haryana High Court has put a judicial stamp on the paper-leak case and stayed the pharmacy officer recruitment process.

So, AAP, will you still deny there was a paper leak? Or will the judicial record finally force you to stop pretending?

And where are CJP, Dipke and the gang, the self-appointed “student activists” who never miss an opportunity to target the BJP?

Why are they missing from Punjab? Why the silence?

The answer is obvious. Their outrage isn’t about students. It is about politics.

When BJP-ruled states are involved, they become professional agitators. When the scandal is in an AAP-ruled Punjab, they suddenly disappear.

कल झारखंड में छात्रों पर हुए लाठीचार्ज के विरोध में आज जयपाल सिंह मुंडा स्टेडियम से अल्बर्ट एक्का चौक तक छात्रों ने मौन मार्च निकाला।

यह मौन मार्च नहीं, हेमंत सोरेन सरकार के खिलाफ छात्रों का बुलंद संदेश है।

कल लाठियां चलीं, आज हजारों छात्र सड़कों पर मौन होकर खड़े हैं। सवाल वही है - अपने हक़ के लिए आवाज़ उठाने वाले छात्रों पर लाठीचार्ज क्यों?

सरकार दमन से आवाज़ दबा सकती है, छात्रों का आक्रोश नहीं।

Sanjay Hegde’s column is not a serious reading of the Bombay High Court judgment. It is, at best, rape apologism dressed up as legal analysis.

He calls the lift-door issue a “demolished central claim”. But the judgment says the exact opposite.

The Bombay High Court specifically examined the lift mechanics, including the evidence of the hotel’s Safety and Security Manager and the lift technician. The Court records that the doors automatically open at a floor, but remain open for only four seconds before the close command is given. It then explains why this does not demolish the survivor’s account:

“it was very much possible for the Respondent to keep his finger on the close button”

And the conclusion is unambiguous:

“the Respondent maneuvered the lift to ensure the doors were shut during the sexual assault.”

That is not a “demolished” claim. That is a judicial finding after examining the mechanics of the lift.

The Court went further. It expressly dealt with the defence argument that the CCTV footage undermined the survivor’s account. It noted that there was no camera inside the lift, while the CCTV established that the two were together, entered the lift and emerged after several minutes. The Court called the footage “direct corroboration” to the extent that it placed them at the scene at the relevant time.

So what exactly is Hegde arguing? That because CCTV cannot show what happened inside an elevator with no camera inside it, the survivor’s account somehow becomes false?

That is not legal analysis. It is the familiar rape-apologist demand for a video recording of the crime.

And then there is the part Hegde appears remarkably keen to minimise: Tejpal’s own words.

The High Court records the 1:30 a.m. SMS:

“the finger tips”

It also records two apology emails sent on 19 November 2013, including a formal apology acknowledging a sexual liaison despite the woman’s “clear reluctance”, and a personal apology acknowledging that the encounter had taken place.

The “coercion” explanation fares no better. The High Court examined the chronology and found no evidence beyond the defence’s assertion that the apologies were coerced. It specifically asked the obvious question: if Tejpal’s position was that nothing had happened, why would he send not one but two apologies, have one circulated to the entire Tehelka staff, and step down as Editor-in-Chief for six months?

The Court’s conclusion is devastating for this line of defence:

“the Respondent’s story that the incidents never took place cannot be believed.”

And it went on to hold that the material on record established that the incidents took place and that the survivor’s testimony inspired confidence.

There is something particularly revealing about Hegde’s column. It spends considerable effort explaining why the trial judge’s reasoning deserves respect, while the Bombay High Court has now set that judgment aside, convicted Tejpal on all the principal charges and sentenced him to 10 years’ rigorous imprisonment.

A senior advocate is entitled to disagree with a judgment. But when the judgment has actually examined the precise evidence he claims was ignored, and reached the opposite conclusion, one has to ask whether this is legal scholarship or simply an elaborate attempt to rehabilitate the defence of a convicted rapist.

The Bombay High Court read the lift evidence. It read the CCTV evidence. It read the SMS. It read the apology emails. It examined the alleged coercion. It heard the corroborating witnesses.

And after doing all that, it convicted Tarun Tejpal.

Hegde should perhaps read the judgment before lecturing everyone else about which judgment “better respects the rules.”

जंतर-मंतर की राजनीति और रांची की सियासत के लिए अलग-अलग तराजू क्यों?

छात्रों के अधिकार किसी पार्टी की सुविधा के मोहताज नहीं हो सकते। जहां भी छात्रों के साथ अन्याय होगा, सवाल उठना चाहिए, चाहे सरकार किसी की भी हो।

रांची के जयपाल सिंह मुंडा स्टेडियम में छात्र शांतिपूर्ण तरीके से बैठे हैं, लेकिन आधी रात को पूरा प्रशासन और भारी पुलिस बल स्टेडियम पहुंच चुका है।

आशंका है कि रात के अंधेरे में कभी भी पुलिस बलपूर्वक छात्रों को वहां से हटाने या उठाने की कार्रवाई कर सकती है। सभी सचेत रहें।

आखिर हेमंत सोरेन सरकार के इरादे क्या हैं? शांतिपूर्ण तरीके से अपने हक की आवाज़ उठा रहे छात्रों से सरकार इतनी डरी हुई क्यों है?

A Bengaluru court issued a non-bailable warrant against crook Prakash Raj in a case alleging multiple voter registrations across Karnataka, Tamil Nadu, Telangana and Andhra Pradesh. The court had issued repeated summons, and he failed to appear. He later appeared and was granted conditional bail.

And now, the irony:

Those who cannot explain multiple voter registrations want us to believe the Election Commission is somehow the problem when duplicate entries are identified and removed.

The ECI’s job is precisely to maintain clean electoral rolls and eliminate duplicate/invalid entries.

You cannot demand electoral integrity when it suits you and cry “democracy under threat” when the electoral rolls are cleaned up.

First explain the multiple voter IDs. Then lecture the ECI about SIR.

Now that the Home Minister has spoken and made the government’s position clear, there should be no ambiguity about what happens next.

The onus of ensuring that Parliament functions smoothly and is not repeatedly disrupted rests squarely on the Leader of Opposition.

If the Opposition genuinely wants Parliament to debate issues of public importance, it must allow the House to function. You cannot demand answers from the government while simultaneously preventing Parliament from doing its job.

The Leader of Opposition must now demonstrate that he is committed to parliamentary democracy, not just political theatrics.

The “3 minutes 10 seconds” argument is a remarkably convenient way of avoiding the real history of Vande Mataram.

Before lecturing the country about “human nature”, perhaps read the historians.

Sir Jadunath Sarkar’s historical introduction to Anandamath makes clear that Bankim’s novel transformed the historical Sannyasi rebellion into a work of patriotic imagination. The song then became one of the great rallying cries of the freedom movement.

R.C. Majumdar put its historical significance even more starkly: Vande Mataram “sounded the clarion call of freedom”, and the novel inspired Bengali youth to “supreme self-sacrifice” during the Swadeshi movement.

And here is the uncomfortable part for Congress apologists:

In 1937, Jawaharlal Nehru himself questioned the song because of its religious imagery. In his correspondence, he called the interpretation of the goddess imagery “absurd”, said the lyrics were “out of keeping with modern notions of nationalism”, and wrote that the background of Vande Mataram could “irritate” Muslims.

The Congress Working Committee subsequently settled on using only the first two stanzas at public gatherings, the very truncated version that became customary.

So let us be clear about what is actually happening here.

For decades, Congress first cut down a national song because of communal sensitivities, and now one of its senior leaders is worried that restoring the full song might take a few minutes too long.

This isn’t about “human nature”. It is the old politics of appeasement dressed up as practicality.

Three minutes of Vande Mataram is apparently an unbearable burden. But generations of Indians who shouted “Vande Mataram” while facing British lathis, imprisonment and the gallows somehow managed to find the time.

The question isn’t whether people can stand for 3 minutes and 10 seconds.

The question is: why does the very idea of restoring the full national song still make some people uncomfortable?

History has already answered that question.
