For context, Standard International Bank plans to build a 32 floor convention center for 3billion Kenya Shillings.
Bomas is being rebuilt for 42billion shillings.
42billion.
That is not a trivial amount of money.
The so-called National Infrastructure Fund is illegal because it deliberately strips public money of constitutional safeguards and concentrates control of those funds in the hands of a single individual.
Under the Constitution, public funds are protected by four non-negotiable safeguards:
Parliamentary approval (Articles 206 & 221)
Public participation and transparency (Articles 10 & 201)
Independent audit and accountability (Article 226)
Collective executive responsibility, not personal discretion
By removing the Fund from the Consolidated Fund and parking it in a private corporate vehicle, these safeguards are extinguished.
