Bravo to @WSJ’s @KimStrassel who is over the target on the sorry state of legacy media reporting on court cases brought against President Trump and his Administration. From her column today:

“It works like this: The administration takes an action that offends liberal sensibilities. Interest groups rush to litigate, sometimes with prepackaged lawsuits. The press quotes liberal law professors and the litigators themselves as to why the suits are worthy. A liberal judge issues an injunction, which is treated as further proof of a lawsuit’s merit. The stories omit any critical analysis of standing, jurisdiction, merits or precedent. When a higher court corrects the legal overreach, the media, rather than acknowledge it got it wrong, insists the judges are in the tank for Mr. Trump.

Consider that ballroom case. When the National Trust for Historic Preservation filed a lawsuit last December to halt the project, the press corps pushed the litigation as a slam dunk. The stories all led with a quote from the suit, presenting as fact that ‘no president is legally allowed to tear down portions of the White House without any review whatsoever...’ The pieces cataloged the laws the administration had supposedly violated, and the claim that any building required the ‘express authority of Congress.’ Critics hailed the early August ruling by the U.S. Court of Appeals for the District of Columbia Circuit to halt the project as evidence of the trust’s legal firepower.

Chief Justice John Roberts’s order last Friday staying that injunction wasn’t accompanied by an opinion and isn’t a ruling on the merits. But any reporter with a half-sharp pencil might have reported the potentially fatal problems with this suit. These were nimbly outlined by Judge Neomi Rao, who dissented from the D.C. Circuit’s injunction.”

I’ve been on a law faculty for 30 years. Wonderful people. Mostly from the left. Some from the far left. Perhaps a half dozen originalists over three decades. The ideologically-driven can never divorce their analysis from their politics. Reporters should thin their “source list” and keep those law profs who were quoted saying (1) birthright citizenship would be upheld along with (2) President Trump’s right to finish the East Wing and (3) the Court would uphold expansive immunity for acts by presidents while in office. These three cases were not particularly difficult. If a law prof swung and missed on all three, find a new law prof or two to consult and quote.

(BTW: @JoshMBlackman of @STCL_Houston and James Phillips of @StThomasLaw were 3/3. There are others. No excuse save advocacy journalism to keep using “sources” who don’t get the easy cases correct.)

I once interviewed an American lawyer who had helped prosecute Nazis at Nuremberg, and he had watched them hang, and when I asked him to describe the experience, he said, “Harrowing,” not because he had any misgivings about Nazis being punished for their crimes, but because we were talking about life and death, and it felt monumental.

This is how normal people think. They don’t celebrate death — even the death of someone who didn’t vote the way they would have preferred he voted. They’re certainly not “overjoyed” by it. They may come to the conclusion that it’s necessary and just, as in the case of the American lawyer at Nuremberg, but they are also cognizant of the gravity, the finality, of death. They are not Bolsheviks or savages about it.

I remember when I worked at CNN and saw @davidaxelrod in the green room. Asked a question that continues to befuddle me. Never got a satisfying response. Here goes again: During entire SCOTUS history, when has there EVER been a liberal justice — appointed by a Democrat POTUS — considered to be a “swing vote,” in the tradition of a Justice Anthony Kennedy. So rare to see the three liberal justices on the current court now EVER act as a “swing vote.”

And yet, Kavanaugh, Gorsuch, ACB, and Chief Justice Roberts (MANY TIMES) side with the liberal wing. Why? Think that Sotomayor or Kagan or KBJ would EVER take a *consequential position not aligned with their preferred ideology? Serious question. Why are “swing votes” almost always right to left? 🤔

Some color on who is & isn't being paid in ICE & CBP via the One Big Beautiful Bill.

Most of ICE & CBP are funded through 2029 via the OBBB and operations won't be impacted if they aren't funded through appropriations, for now.

All frontline law enforcement is being paid. The ICE, Border Patrol, and CBP agents we see in the field are all getting paid via OBBB. 

HOWEVER... their professional and civilian support staff are NOT being paid. These are people who work the computers, the public affairs offices, and other support staff who aren't on the front line making immigration arrests, but are supporting the agents who are.

These civilian support staffers haven't been paid for almost half of the last six months when you factor in the prior shutdown last fall. They feel left behind - and feel they have no light at the end of the tunnel with this Senate bill leaving CBP & ICE unfunded through appropriations. They would have to hope GOP could take care of them in a future reconciliation bill, or that more funds could be moved around to pay them.

These are some texts I've gotten from these staffers...

CBP support employee: 

"The senate bill paid TSA but thousands of CBP & ICE professional staff will not be paid.   The last paid work day for me was February 13.  Now senate on paid vacation until April 13 that is a guarantee for 2 months no pay.  Very likely we won’t be paid until May if Johnson lets the bill pass."

ICE civilian employee:

"I have a huge favor. When you guys report on the fact that ICE is funded through OB3 funds, can you please make it known that support staff (i.e. mission support, OPA, etc.) is NOT getting paid?"

HSI civilian employee:

"We civilians are not getting paid, I'm working with my mom in the hospital and not getting paid. This is all so frustrating...sorry bill for venting!"

Because Senate Democrats didn’t end up accepting the Republican offer on DHS funding & negotiations fell apart yesterday, Dems will get *zero* of the ICE reforms they had been demanding, including ones that GOP had already agreed to, like showing ID, increased Congressional oversight, agreements to not hit sensitive locations, etc.

These reforms were the reason Dems started the shutdown in the first place, and now instead of getting a few concessions on their demand list, they get none.

The only thing they secured was no funding for CBP & ICE, which are largely already funded via the OBBB, and Republicans will seek to fund them even further without Dem votes in reconciliation instead.

As for the Dem’s demand list on ICE reforms?

“That ship has sailed,” Sen. Majority Leader John Thune said this morning. “They kissed that opportunity goodbye by failing to provide funding for those agencies.”

🗣️ DO NOT let the miserable, anger-addicted fringe (and the bots) steal our joy about America’s hockey gold medals. Simply refuse to let it happen.

A moment of epic victory and unity is being assaulted by a small handful of internet accounts pretending to be super, super mad that our guys — in a state of total euphoria and celebration — laughed at a dumb boomer jokey comment from POTUS during an impromptu celebratory FaceTime in the lockerroom.

Trump was like, ‘you know we have to invite the women’s team too, or else they’ll impeach me.’ When he mentions bringing our awesome gold medal ladies to DC, you hear several of the boys say “absolutely” and “two for two!” These teams are obviously close friends, and now they share an earned place in history. The exhausting Miserables don’t care. They love division and grievance and they want to drag this down into their pathetic, joyless sewer. Don’t let them.

On social media (I was mostly checking Instagram), these people are swarming to the guys’ accounts, and their teams’ accounts. They’re all posting the same types of negative attacks, over and over, often from the exact same people/“people,” then ‘liking’ the hate to boost them to top comment status. The themes are:

1) The guys ruined everything & now I wish Canada had won

2) The guys are rapists (“cover your drinks, ladies”)

3) Men suck. Only congratulate the women’s team

4) kAsH PaTeL!!!

5) Epstein / pedos (?!)

Whether these are real people caught up in their latest Thing to fill the voids in their souls, or foreign bots (absolutely would not be surprised if this is a factor), they are targeting out guys to try to demoralize them & make it seem like there is some national uprising against them for the “sin” of that phone call. It’s ridiculous. They’re infesting these accounts to try to bully people into “apologies” and “accountability.”

It’s an unhinged, bad old fashioned, 2020-style Cancel Mob. The players seem to be responding perfectly by refusing to respond to this BS and partying their asses off in packed Miami clubs. I think the best thing we can do is show up online and reject these bullies. Fight the negativity with enthusiasm and pride … deny them the AstroTurf feedback loop/echo chamber they’re trying to manufacture.

The normals need to stand up here. Don’t be abusive. Just make the following message clear: 🖕your divisive garbage, we love our men’s and women’s CHAMPS. U-S-A! 🥇
