@joeroganhq She is wrong. Illegal entry into the U.S. is a criminal offense, which is a misdemeanor for a first offense and a felony for repeat offenses. She's confusing it with visa overstays, which are generally civil immigration violations.

@NicoletteGlazer I am not sure how accurate this is. The policy only came out yesterday, yet the RFE already includes the requirements outlined in it. RFEs usually take a few business days to ship. The timeline does not add up.

Regarding the new @USCIS memo, R1 visas are classified as partial dual intent. I have no idea to what extent this policy affects the visa type. However, as religious workers, always be sure to highlight the positives you bring to your community.

New USCIS rule effective July 10: if an adjudicator finds an invalid signature after your petition is receipted, they can DENY it and keep the fee. No cure. No do-over.

What counts as invalid:

Copy-pasted signature images
Stamps
Signatures by anyone other than the requestor (yes, including the attorney)
Signature software

For H-1B cap cases, PERM-backed I-140s, and anything with a statutory deadline, a signature denial discovered 18 months in could cost the entire filing window.
