On Tuesday, 9 June 2026, the European Justice Forum, in partnership with @EFPIA and @medtecheurope, hosted a working lunch at the @Europarl_EN in Brussels 🇪🇺 on “𝘓𝘪𝘢𝘣𝘪𝘭𝘪𝘵𝘺 𝘍𝘳𝘢𝘮𝘦𝘸𝘰𝘳𝘬𝘴 𝘪𝘯 𝘵𝘩𝘦 𝘓𝘪𝘧𝘦 𝘚𝘤𝘪𝘦𝘯𝘤𝘦𝘴 𝘚𝘦𝘤𝘵𝘰𝘳 𝘢𝘯𝘥 𝘐𝘮𝘱𝘭𝘪𝘤𝘢𝘵𝘪𝘰𝘯𝘴 𝘧𝘰𝘳 𝘵𝘩𝘦 𝘌𝘜 𝘚𝘪𝘯𝘨𝘭𝘦 𝘔𝘢𝘳𝘬𝘦𝘵”.

The event brought together policymakers, legal experts, industry representatives, and other stakeholders for a timely discussion on the evolving regulatory and litigation landscape affecting Europe’s life sciences sector. The conversation focused on how EU liability reforms and third-party litigation funding may influence innovation 💡, investment certainty 📈, competitiveness, and consumer trust 🤝 across the Single Market.

⚖️ Speakers highlighted the importance of maintaining strong consumer and patient protections while ensuring that Europe’s liability framework remains balanced, proportionate, and supportive of research and development in highly regulated industries.

In this episode, Andrew Mills (EJF Board Member) explains that under the Representative Actions Directive (#RAD), regulation of third-party litigation funding (#TPLF) remains limited.

Most obligations apply to the qualified entity, not the funder itself. This gap allows TPLF to expand rapidly. Countries with little or no safeguards may attract more funded cases raising concerns about forum shopping.

🇩🇪⚖️"Germany’s draft law implementing the revised EU Product Liability Directive received mixed reactions from experts in the German Bundestag’s Committee on Legal Affairs and Consumer Protection hearing”, comments Dr Herbert Woopen for EJF.

The draft reform proposes i.a.:

▫️product liability rules expansion to software and artificial intelligence systems,
▫️introduction of liability for certain actors in the supply chain where manufacturers are based outside the EU,
▫️damage claims facilitation.

During the hearing, Julian Kulaga - German Chamber of Industry and Commerce (DIHK) supported introduction of a fully-fledged “in camera procedure”into German civil procedure law 📄🔒.

The proposal would ensure that only the court receives full access to confidential evidence, while parties and their representatives would receive only the court’s assessment, without disclosure of trade secrets or other confidential business information 🛡️.

Concerns were also raised that the absence of procedural safeguards could decrease Germany’s attractiveness for businesses 🇪🇺.

The Financial Times recently covered rising US business concerns around the revised EU Product Liability Directive (PLD), including claims that the new framework could shift the burden of proof onto defendants in complex cases. A letter from EJF, recently published in the @FT, sets the record straight.

The impact of the revised PLD is not limited to US companies. It affects 𝐚𝐥𝐥 𝐛𝐮𝐬𝐢𝐧𝐞𝐬𝐬𝐞𝐬 𝐨𝐩𝐞𝐫𝐚𝐭𝐢𝐧𝐠 𝐢𝐧 𝐭𝐡𝐞 𝐄𝐔, with significant implications for costs, legal certainty, and innovation capacity.

At a time when Europe is striving to enhance competitiveness, the broader context matters:

• expanding liability and easing evidential burdens already risks increasing litigation exposure across sectors
• growing third-party litigation funding and mass claims trends are reshaping the enforcement landscape
• inconsistent implementation across Member States risks fragmenting the Single Market

There are questions about whether the current trajectory is aligned with the EU’s stated priorities of 𝐬𝐢𝐦𝐩𝐥𝐢𝐟𝐢𝐜𝐚𝐭𝐢𝐨𝐧, 𝐢𝐧𝐧𝐨𝐯𝐚𝐭𝐢𝐨𝐧, 𝐚𝐧𝐝 𝐠𝐫𝐨𝐰𝐭𝐡.

The call is therefore clear:
➡️ pause implementation
➡️ conduct a proper impact assessment
➡️ ensure consistent application across Member States and courts

A balanced approach is essential, one that protects consumers 𝐰𝐡𝐢𝐥𝐞 𝐬𝐚𝐟𝐞𝐠𝐮𝐚𝐫𝐝𝐢𝐧𝐠 𝐢𝐧𝐧𝐨𝐯𝐚𝐭𝐢𝐨𝐧, 𝐢𝐧𝐯𝐞𝐬𝐭𝐦𝐞𝐧𝐭, 𝐚𝐧𝐝 𝐭𝐡𝐞 𝐢𝐧𝐭𝐞𝐠𝐫𝐢𝐭𝐲 𝐨𝐟 𝐭𝐡𝐞 𝐒𝐢𝐧𝐠𝐥𝐞 𝐌𝐚𝐫𝐤𝐞𝐭.

Important analysis by @ECIPE shows the substantial economic burden imposed by the revised Product Liability Directive (PLD).

As implementation progresses unevenly across the Member States, the cumulative impact on EU manufacturers of the reversal of the burden of proof in PLD, combined with unregulated TPLF and increasing US-style mass litigation, has long been flagged as a major concern by European industries in all sectors.

On our latest analysis, @FredrikErixon, @osguinea, @Phil_Lamprecht, Dyuti Pandya, and Vanika Sharma find that the revised PLD could reduce EU GDP by up to 0.24 per cent, cost European households up to €33 billion in purchasing power, and cause insurance premiums in newly covered sectors to surge by as much as 40 per cent. The international fallout is equally sobering, with EU imports projected to fall by up to €36.5 billion, hitting strategic allies hardest.

With the December 2026 transposition deadline approaching, the stakes could not be higher.
