๐ฉ๐ชโ๏ธ"Germanyโs draft law implementing the revised EU Product Liability Directive received mixed reactions from experts in the German Bundestagโs Committee on Legal Affairs and Consumer Protection hearingโ, comments Dr Herbert Woopen for EJF.
The draft reform proposes i.a.:
โซ๏ธproduct liability rules expansion to software and artificial intelligence systems,
โซ๏ธintroduction of liability for certain actors in the supply chain where manufacturers are based outside the EU,
โซ๏ธdamage claims facilitation.
During the hearing, Julian Kulaga - German Chamber of Industry and Commerce (DIHK) supported introduction of a fully-fledged โin camera procedureโinto German civil procedure law ๐๐.
The proposal would ensure that only the court receives full access to confidential evidence, while parties and their representatives would receive only the courtโs assessment, without disclosure of trade secrets or other confidential business information ๐ก๏ธ.
Concerns were also raised that the absence of procedural safeguards could decrease Germanyโs attractiveness for businesses ๐ช๐บ.

On our latest analysis, @FredrikErixon, @osguinea, @Phil_Lamprecht, Dyuti Pandya, and Vanika Sharma find that the revised PLD could reduce EU GDP by up to 0.24 per cent, cost European households up to โฌ33 billion in purchasing power, and cause insurance premiums in newly covered sectors to surge by as much as 40 per cent. The international fallout is equally sobering, with EU imports projected to fall by up to โฌ36.5 billion, hitting strategic allies hardest.
With the December 2026 transposition deadline approaching, the stakes could not be higher.
