Joining the GMO foods conversation, in Kenya, Farmers can go to jail for selling non-GMO. It’s starts like a good courtesy and then strips farmers off their autonomy and essentially the population

- The Seeds and Plant Varieties Act prohibits farmers from sharing, exchanging, selling, or multiplying uncertified and unregistered seeds for commercial purposes. This includes indigenous (non-GMO) seeds, which are often saved and shared through informal farmer-managed seed systems. Violators can face penalties of up to two years in prison, a fine of up to KES 1,000,000 (approximately USD 7,692), or both.

- The law does not explicitly ban planting non-GMO seeds for personal, non-commercial use. According to the Kenya Plant Health Inspectorate Service (KEPHIS), the Act does not prohibit farmers from saving and sharing indigenous seeds for non-commercial purposes.

- The restrictions are controversial because they limit traditional practices where farmers freely exchange indigenous seeds, which are non-GMO and valued for their resilience, nutritional value, and cultural significance. Critics, including organizations like Greenpeace Africa and the Seed Savers Network, argue that the law favors large seed corporations and threatens food security, biodiversity, and farmers' livelihoods by criminalizing informal seed systems that supply 80-90% of seeds used in Kenya.

- In 2022, a group of 15 smallholder farmers filed a lawsuit challenging the constitutionality of the Act, arguing it violates their traditional rights and Kenya’s Constitution, which recognizes the protection of indigenous seeds and cultural heritage. The case is ongoing, with a hearing scheduled for July 24, 2024, and has gained support from groups like the Law Society of Kenya.
