Why now? Today, October 1, Italy renewed its border controls on travellers from Spain, for the fourth time since August 8. Neither government has shown the serious threat to public policy or internal security that EU law requires; instead, they pursue an unprecedented tit-for-tat dispute.

And it's not just Italy and Spain. The map below shows how "temporary" internal border controls have become semi-permanent across much of Schengen.

Who pays? Workers, students, families and patients, caught in a dispute between two governments over the fallout from Ceuta.

This failure reflects a broader institutional trend. The Commission may enjoy wide discretion in deciding whether, when and how to enforce EU law. But wide discretion is not unbounded discretion, and it cannot become permission to decide which European rules still matter. Its enforcement choices must themselves comply with the rule of law.
