[Helsińska Fundacja Praw Człowieka @hfhrpl]

ETPC wydał wyrok w sprawach Sherov i Inni przeciwko Polsce, w którym uznał, że w stosunku do opozycjonistów z Tadżykistanu Polska naruszyła przepisy Europejskiej Konwencji o Ochronie Praw Człowieka. Fundacja reprezentowała skarżących przed Trybunałem wraz z działającym pro bono mec. Jackiem Białasem.

Skargę do ETPC wniosło wniosło czterech obywateli Tadżykistanu, którzy między grudniem 2016 a lutym 2017 r. wielokrotnie próbowali przekroczyć granicę polsko-ukraińską, korzystając z oficjalnych przejść granicznych i składając wnioski o ochronę międzynarodową z powodu narażenia na prześladowania polityczne w kraju pochodzenia. Wnioski były odrzucane, a wnioskujący odsyłani do Ukrainy.

Przed wydaleniem ich do Ukrainy władze polskie na żadnym etapie nie wykazały, że na jej terytorium mężczyźni mają szansę na uzyskanie ochrony międzynarodowej. Z Ukrainy mogli więc zostać deportowani z powrotem do Tadżykistanu, gdzie groziłyby im prześladowania.

Pod koniec stycznia 2017 r. w sprawę zaangażowała się Helsińska Fundacja Praw Człowieka.

Trybunał przyznał skarżącym rację, a wśród naruszeń Konwencji stwierdził https://t.co/Tf7IB1qsbY. zakazane prawem międzynarodowym zbiorowe wydalenie cudzoziemców.
