✅National Treasury CS John Mbadi Ng’ongo, on official Government of Kenya letterhead (Ref: TNT/CONF.CS/VOL.1), dated 12th May 2026, wrote to Kisumu Governor Prof. @AnyangNyongo and Senator @ProfOjiendaTom
✅The letter announces he will be in Kisumu on 15th & 17th May 2026
✅Item 2 of his programme — underlined in red — reads: “Meeting with ODM county delegates in Kisumu on May 17, 2026 from 10.00am”
✅He signs the letter personally as Cabinet Secretary

⚖️ THE CONSTITUTIONAL VIOLATIONS
✅Article 10 — National values and principles of governance require that all State officers act with patriotism, integrity, and transparency in the public interest — not partisan interest
✅Article 73(1)(a) — State officers must exercise authority in a manner that demonstrates respect for the people and brings honour to the nation — not advance party machinery using state instruments
✅Article 73(2)(b) — The guiding principles of leadership and integrity expressly prohibit use of public office for private gain or partisan advantage
✅Article 75(1) — A State officer shall not act in a manner that constitutes a conflict of interest — using the National Treasury letterhead and presumably state resources to organize ODM delegate meetings is a textbook conflict
✅Article 232(1)(f) — Public service values require impartiality and objectivity — a CS cannot be both the custodian of the national fiscus and an active ODM party mobilizer on duty

🧨 WHY THIS IS UNIQUELY GRIEVOUS
✅This is not a case of a CS attending a party event privately — he is announcing it on official letterhead, making it an official government communication
✅He is inviting a Governor to extend the invite to Members of County Assembly — using a Governor’s office as a party mobilization conduit funded implicitly by state resources
✅He copies Sen. Prof. Tom Odhiambo Ojienda, SC — the Kisumu Senator — on official Treasury correspondence about an ODM delegates meeting. The Treasury has zero business with ODM delegates
✅The use of Treasury reference number TNT/CONF.CS/VOL.1 means this letter was registered, processed, and filed in the official government registry — making this a documented misuse of public office
✅He thanks the Governor for “continued support” — language of a party operative, not a constitutional officer managing Kenya’s public finances

📢 WHAT MUST HAPPEN NOW
✅Mbadi must issue an immediate, unreserved public apology to Kenyans for this gross misuse of his constitutional office
✅He must refund any public resources — staff time, vehicles, security, logistics — deployed in organizing or attending the ODM delegates meeting
✅If he refuses to apologize, President @WilliamsRuto must act under Article 152(6) and remove him — a CS who cannot distinguish between his constitutional office and his party card has no business managing Kenya’s national finances
✅@NAssemblyKE Public Accounts Committee and relevant departmental committee should summon him to account for this breach
✅@EACCKenya should take note — this is the precise conduct Section 11 of the Leadership and Integrity Act, No. 19 of 2012 was designed to address
🔴 A man who uses the @KeTreasury letterhead to organize ODM delegate meetings is not a Cabinet Secretary who happens to belong to ODM. He is an ODM official who has accidentally been given the keys to the National Treasury. Kenya cannot afford that confusion — literally.​​​​​​​​​​​​​​​​ it’s beyond what a political skunk can do!
