Civil rights advocacy is protected expression, not unlawful coordination.
The Lawyers’ Committee for Civil Rights Under Law recently filed an amicus brief in Media Matters for America v. Federal Trade Commission, a case with major implications for nonprofits and advocacy organizations working to combat hate and discrimination.
As Leah Frazier, director of the Digital Justice Initiative at the Lawyers’ Committee, said: “When the government uses its investigative power in ways that burden advocacy, it threatens more than one organization—it sends a warning to every group working to challenge hate and discrimination. Civil rights advocacy is protected expression, not unlawful coordination.”
At stake is whether the government can use expansive investigative demands in ways that chill protected advocacy, drain nonprofit resources, and deter organizations from speaking out against injustice.
Oral argument is scheduled for April 13. We’ll continue fighting to ensure civil rights groups can advocate boldly and hold powerful institutions accountable without fear of retaliation.
