I am a farmer and the outright owner of a $400,000 John Deere combine, and this morning a sensor decided I am not allowed to drive it.

The sensor was working perfectly. That was the problem. An emissions reading drifted, the machine did what the manual calls a derate and everyone out here calls limp mode, and now I have a full tank, a full engine, and 3 miles an hour. It is October. The forecast is rain Thursday. The corn does not care about the settlement.

I did everything you are supposed to do. I bought it outright. I did not lease. I have the title, the manual, the torque specs, and 40 years of knowing which bolt is which. I can rebuild the engine on a tailgate. What I cannot do is tell the engine it is allowed to run.

Because the thing that stopped it is not a part. It is a permission. The reset lives in software, the software lives with the dealer, and the dealer is 90 minutes away and booked through Friday.

So I called. I always call. That is the instruction, and I follow the instruction.

They said someone could come Monday. I said the crop will be down by Monday. They said they understood. I have learned that when a company says it understands you, it means it has written down that you were told.

Yesterday the FTC announced I won. Right to repair. 10 years of it. I read the whole thing at the kitchen table with the combine sitting dead in the field I can see from the window.

Here is what I learned about winning. The settlement says I get the same software the dealer gets, eventually, on a schedule they report every 60 days. It does not say the software arrives before the rain. It does not say the machine will listen to me tomorrow. It says that someday, carefully, I will be allowed to ask it the same way the dealer asks it.

I own the steel. I always did.

I just found out I have been renting the word go, and the lease has 10 years left, and the corn is still in the field.

The DOJ widened the net dramatically, adding Smartmatic itself and its parent company SGO Corporation as corporate defendants. This is the government saying the rot wasn’t just a few bad apples — the company allegedly benefited from the scheme and the executives were acting on its behalf.

🎭 “Politically Motivated” — The Irony Is Staggering

Smartmatic’s defense is that these charges are politically motivated. Let’s sit with that for a moment.

This is the same Smartmatic that:

- Filed sweeping defamation lawsuits against Fox News, Newsmax, OANN, Mike Lindell, Sidney Powell, and Rudy Giuliani

- Claimed those defendants recklessly lied about election fraud and destroyed their reputation

- Positioned themselves as the victim of baseless, politically-driven attacks on their integrity

Now the actual DOJ — not some cable news host, not a pillow CEO — has a federal grand jury finding probable cause that Smartmatic executives engaged in international bribery to secure contracts. And Smartmatic’s response? “Politically motivated!”

You can’t spend years in court arguing “we are a legitimate, honest company maliciously defamed by election-fraud allegations” and then, when the DOJ indicts you for actual criminal bribery, cry that this is the real political hit job.

🏛️ The Lindell Lawsuits: Still Going?

This is where the absurdity peaks. Smartmatic is simultaneously:

1. Defending itself against federal criminal charges for bribery and FCPA violations

2. Prosecuting civil defamation claims against Mike Lindell and others for saying they’re corrupt

The defamation cases rest on the premise that Smartmatic suffered reputational harm from false accusations of shady election practices. But a federal indictment for bribing foreign election officials isn’t exactly a reputation-builder. At some point, the question becomes: what reputation exactly was damaged?

Smartmatic’s defamation claims demand they prove:

- The statements about them were false
- The statements caused actual harm
- The speakers acted with actual malice

When the DOJ is simultaneously arguing in federal court that your executives laundered bribe money to secure election contracts, proving those statements were “false” gets... complicated. The “actual harm” argument gets even murkier when the reputational damage might be coming from your own criminal indictment rather than a MyPillow commercial.

💰 Follow the Contracts

The Philippine scheme wasn’t small potatoes:

- $1M in bribes → $200M in contracts — that’s a 200x return on corruption investment

- The contracts were for voting machines and election infrastructure — the same type of work Smartmatic does elsewhere

- This raises obvious questions about how they secured contracts in other jurisdictions, including the United States

Smartmatic’s involvement in US elections has always been downplayed as minimal — “we only operated in Los Angeles County in 2020.” But the Philippine allegations show a systematic approach to securing election infrastructure contracts through alleged bribery. Election integrity advocates have been raising flags about this company for years, and the DOJ’s case suggests those concerns weren’t baseless.

🎯 The Bigger Picture

Smartmatic’s defamation blitz against conservative media figures was always about more than money. It was a legal intimidation strategy — to sue everyone who questions election integrity into silence through discovery costs and fear of liability. The strategy worked on some: Fox settled for $787 million, Newsmax settled too.

But the DOJ indictment rewrites the calculus entirely. You can’t SLAPP your way out of a federal criminal case. And you can’t simultaneously argue “we’re an honorable company defamed by election truthers” while fighting FCPA charges for bribing foreign election officials.

The audacity of Smartmatic calling the DOJ politically motivated isn’t just ironic — it’s almost certainly a preview of their criminal defense strategy. Paint themselves as victims of the same “election denialism” machinery they’ve been litigating against. The difference is that a federal grand jury has already found probable cause. That’s not a cable news segment. That’s evidence.
