@WilliamLoud85 What I mean by procedural is that an executive order from the president cannot override existing federal law and it can't override or clarify what's in the Constitution.
My theory on how SCOTUS decides Trump v. Barbara (birthright citizenship):

@CharlesHughes62 Kim Wong Ark did not bring up the issue of people who are not lawfully in the United States and/or are not lawful permanent residents. The parents of Kim Wong Ark were both lawful permanent residents. My opinion on how that phrase should be defined leaves Kim Wong Ark intact.
@CharlesHughes62 That may be true but those two phrases do not mean the same thing. All persons born in the United States and subject to the jurisdiction thereof. Those two clauses do not mean the same thing and will never be interpreted that way. It must have deeper meaning than mere presence.
@Josh_HokitUFC I'm going to be honest you're safe from any comments directed at Big Mike, at least as far as defamation claims are concerned. The reason is simple, Big Mike would have to prove he is not a man and is a woman, otherwise it's not defamation it's just stating a fact.
Bottom line: EO struck down, "subject to the jurisdiction thereof" defined as domicile + allegiance, and an administratively clean rule that Congress could codify tomorrow. The Court won't render the 14th Amendment's second clause meaningless. Textualism demands a definition.
