CLARITY Act — short brief (Sept 15, 2026)
What’s happening today
Senate cloture vote on the motion to proceed to H.R. 3633 (~2:15 p.m. ET)
Needs 60 votes
This is not final passage — only the door-open vote
Fail = likely dead for this Congress
Pass = GOP offers the new 635-page substitute and debate continues
What the bill does
Splits crypto: CFTC for digital commodities, SEC for investment-contract assets
Rules for exchanges, custody, consumers, developers, stablecoins
House already passed it 294–134 (July 2025)
Senate Banking passed it 15–9 (May 2026)
What’s in the final GOP text (Sept 14)
126 changes Democrats requested
Ethics: no issuing/sponsoring tokens; divest or blind trust for significant holdings
State AGs get enforcement role
2029 sunset removed
Treasury “circuit breaker” if stablecoin rewards drain community-bank deposits
Narrower developer safe harbor (BRCA)
Is the ethics package enough?
Strongest version yet — not cosmetic
Still not enough for the Democrats who control the 60-vote math
Gaps: hard to sue the President directly; possible OGE waiver; family/related entities may slip through; civil, not independent, enforcement
Democrats sent a counteroffer late Monday night
Vote math
GOP: 53 seats
Need ~7 Democratic yeses if GOP is unified
Real ask may be 8–10 (possible GOP nos: Hawley, Paul; Collins/Cornyn undecided)
Gallego and Alsobrooks were always conditional on ethics
Odds
Cloture today: uncertain / lean tight
Signed into law in 2026: about 25–30%
Galaxy: ~30%
TD Cowen: ~25%
Miss this window → 2027 rewrite after midterms
Counter-proposal that could close it
AG power that actually reaches covered executive officials
No easy OGE “keep the stake” notice for President/VP/spouses
Cover beneficial ownership and family entities, not just the official’s name
Keep the bank deposit-flight breaker
Keep a real civil safe harbor for non-custodial developers
The market-structure bill is ready. The ethics enforcement design is not. Today prices that gap.

If the Clarity Act fails, Democrats own what comes next: more 100 Democratic-directed changes wasted, consumers with zero federal protection, no disclosure rules, no delisting requirements for bad actors, stuck in the same unregulated system that has already cost Americans billions. They wrote the fix. They must pass it.
President Trump had already agreed to the toughest ethics restrictions on federal officials in American history to get this bill done. Now, to close the deal, he went further — including giving state Attorneys General enforcement power. 🧵
Tomorrow, my colleagues have a choice to make: American leadership, real consumer protections, and giving law enforcement the tools they need to address illicit finance, or drive the digital asset industry overseas, leaving consumers vulnerable, and sidelining American leadership knowing full well that no other country is capable of regulating this industry as well as the United States. The choice really is that clear. The Clarity Act is right in front of us and this moment won’t come along again for years. Let’s take the win and get this done.
Clarity Act vote tomorrow + Fed this week.
Here’s the real matrix, not hopium: Clarity passing is bullish for the industry, not a magic $100K button for BTC. Bitcoin already has commodity status.• Fed hold is the base case. A 25bps hike is the risk, not a surprise nuke.• Current $77.5K already sits between “regulation delayed + hold” and “mild disappointment.”My scenarios:Clarity advances + Fed holds
→ $88K–$98K
Best case for Q4.
Clarity delayed + Fed holds
→ $72K–$85K
Most likely. Grind, not moon.
Clarity delayed + Fed hikes 25bps
→ $68K–$75K
Painful but not fatal.
Clarity dies for 2026 + hawkish hike
→ $62K–$70K
That’s the real downside, not $60K crash.
Don’t trade the tweet. Trade the 60-vote math and the dots.Clarity is a sentiment catalyst. Liquidity and rates still run the show.$77.5K is not cheap and not expensive. It’s waiting for tomorrow.

CLARITY ACT UPDATE — Sept 14, 2026
Final Senate text just dropped. Procedural vote is tomorrow.
Bill:** Digital Asset Market Clarity Act (H.R. 3633)
What it does:** Draws the line between digital commodities (CFTC) and securities (SEC). Market-structure rules for crypto, not a “make crypto legal” switch.
House:** Passed 294–134 in July 2025
Senate Banking:** Advanced 15–9 in May 2026
Next vote:** Cloture on the motion to proceed
Tuesday, Sept 15, 2026 — 2:15 p.m. ET
Needs 60 votes. GOP has 53. That means ~7 Democratic yes votes.
This is not final passage. If cloture fails, the 2026 window gets very thin before midterms.
Prediction markets (becoming law in 2026):
Polymarket:* ~23–30% after the revised text — up from the mid-teens / August lows. Still prices *No** as the favorite.
Kalshi:* ~25% for enactment by end of 2026. Higher odds that the Senate *votes than that the bill becomes law this year.
Calendar is brutal: short September window, House voting days cut, midterms looming. Even a cloture win is only step one (debate → Senate pass → House again if text changed → signature).
Stay active. Watch the 2:15 p.m. ET vote. Clarity is the product. Crypto is the future.

End of an era… 💔
The visionary who helped bring Cartoon Network to life, giving generations a home for unforgettable cartoons and childhood memories, has sadly passed away. Ted Turner transformed television and entertainment through his groundbreaking media empire, leaving an incredible legacy that continues to live on through the worlds he helped create. 🕊️

Democrats helped write the Clarity Act, securing more than 115 wins in the text. They demanded the felony bar on fraudsters, $150M for the CFTC, the crackdown on platforms like Binance, and they got almost everything they asked for. Now they need to vote for the bill they built. Anything less is walking away from their own work.
After a year of intense daily bipartisan negotiations, this bill is ready. Here is the final text. President Trump voluntarily agreed to new ethics provisions holding every federally elected official, judge, and their spouses to some of the toughest ethics restrictions in U.S. history. This new text includes more than 120 of Democrats' demands. A no vote on Tuesday means opposing real ethics reforms on politicians' personal investments, handing American leadership in digital assets to our foreign competitors, and leaving Americans with zero protections in the digital asset markets. Democrats got what they wanted; now they need to take yes for an answer. Here's the latest: https://t.co/pd9VjCk9MA
