The SEC’s Frantic and Unprecedented Rampage to Dismantle its Crypto-Enforcement Program Continues: This Time, Halting Two SEC Appeals Dead in Their Tracks (Buckle up XRP Army, the Ripple Appeal Has Got To Be Next on the SEC Chopping Block)
The U.S. Securities and Exchange Commission (SEC) continues its frantic race to eliminate all fragments, remnants and artifacts of its crypto-enforcement program.
Yesterday, the SEC moved to dismiss its appeal over whether crypto firms should be tagged as securities “dealers,” dropping its bid to revive its expansion of the dealer definition at the Fifth Circuit after industry groups representing private funds and crypto firms successfully challenged the rule in Texas federal court last year.

Yet Another Gensler Rebuke. The SEC had filed its appeals in both the case brought by the National Association of Private Fund Managers, the Managed Funds Association and the Alternative Investment Management Association and the crypto-focused challenge brought by the Blockchain Association and the Crypto Freedom Alliance of Texas on Jan. 17, just days before the departure of then-Chair Gary Gensler.
Sorry Gary -- your last ditch effort to quarterback crypto-enforcement from the grave is failing miserably.
SEC Statement. The one-page dismissal notices did not provide details on why the SEC decided to walk away from the matter, but in a shocking SEC reversal, an SEC spokesperson told Law360 that the court's order found the rule exceeded the agency's authority:
“The Court found that the Commission's rule would classify nearly any person who buys and sells securities as a 'dealer,' extending beyond its statutory authority," said the spokesperson. "We dismissed the appeal because continuing to pursue it had the risk of reducing liquidity in the Treasury markets, making them more volatile, and increasing debt for taxpayers."

That Makes Five SEC Enforcement "Crypto-Pauses" In The Last Few Days -- An SEC Record. Since acting SEC Chair Mark Uyeda took the SEC helm, the SEC has now filed five SEC crypto-litigation “Pauses.” The SEC's strategy is to grind all crypto-related SEC litigation to a screeching halt under the auspices of the need to wait for the findings of a new crypto task force helmed by SEC Commissioner and famed "Crypto-Mom" Hester Peirce, a frequent dissenter in Biden-era crypto enforcement actions.
For instance, the SEC cites the Task Force's analysis as a factor that could “impact and facilitate the potential resolution” of future, in the notorious SEC cases involving crypt-exchanges Coinbase Global Inc., Binance Holdings Ltd., and Lejilex.
Strange Things Are Afoot at SEC HQ. Never before in the history of the SEC has this kind of radical turnabout in SEC enforcement policy ever taken place. Never, ever, ever.
Along the same lines, the SEC yesterday formally cancelled its Crypto Unit (rebranding it as a Cyber Unit) and began “disappearing” SEC crypto-staff, including the head of the SEC litigation and the former co-chief of the former Crypto Unit.
What’s Next? It's the perfect storm at the SEC: A President who does not trust the SEC; A crypto czar who has no respect for the SEC; And a DOGE Director Who hates the SEC. That's not good for SEC staff.
In fact, a DOGE team will reportedly be knocking at the SEC door any minute and an SEC RIF together with a broad and sweeping reorganization seems imminent.
The Ripple appeal is also most certainly next in line for dismissal. Why? Because the new SEC top brass has made it crystal clear that the SEC will never file another court pleading of any kind arguing that a digital asset is a security, at least not until the Crypto Mom's Task Force has completed its mission.
Buckle Up, Get the Popcorn and Get Ready For The SEC Funeral. The SEC crypto-enforcement carnage has really just begun to litter the streets. My guess is that all SEC crypto-related investigations have already been secretly "paused" and that SEC crypto-enforcement resources have already been shifted to other priorities.
Oh, and one more thing, when the crypto contagion spreads across the global capital marketplace like wildfire and the crypto-crime wave floods U.S. cities and towns like a tsunami, ask not for whom the bell tolls, it tolls for thee (and whoever is the SEC Chair at the time).
