Lie No 3: BJP secretly gave Election Commissioners blanket immunity from arrest and legal action.

Facts: Absolutely false.

Section 16 of the 2023 CEC and Election Commissioners Act is in the publicly available law passed by the parliament. It protects the CEC and Election Commissioners from civil or criminal proceedings for acts done while performing, their official duties.

The Judges (Protection) Act, 1985 contains similar protection for judges. MPs also have constitutional protection for their speeches and votes in Parliament. Protecting the exercise of an official function is not a new thing nor a secret invention.

Section 16 does not grant blanket immunity from arrest or protect conduct outside an Election Commissioner’s official role.

Nor does it prevent removal: the CEC can be removed through the same constitutional process as a Supreme Court judge, while another Election Commissioner can be removed on the CEC’s recommendation.
