Judge Carl Nichols in D.C. has issued an injunction against the Trump Admin. Postal Regulation involving the use of mail-in ballots.

His decision states that problem with the regulation is the creating of the lists of participating voters and the electronic portal through which voter information must be delivered by states to the USPS. He finds as of now that neither involves the handling of mail, and the regulatory authority of the USPS to make regulations applies to matters involving the handling of mail.

Without the needed authority having been given to the USPS by Congress, the regulation is beyond the authority of the USPS to impose on states as a precondition to handling the states' election related mail.

Notably, in applying the ultra vires doctrine he relies heavily on D.C. Circuit Court decisions -- as he should.

BUT, he ignores almost entirely recent Supreme Court decisions that have narrowed the use of the "ultra vires" doctrine, calling it a "Hail Mary."

He does not dwell on the issue at length, but he does spend a significant amount of time considering the potential chaotic disruption that could result from allowing the regulation to be enforced in an election only 6 weeks away.

My view has been -- and remains -- that if Judge Nichols joined Judge Talwani in issuing an injunction, the Supreme Court was almost certain to not grant the Stay Application filed by the DOJ as to Judge Talwani's injunction.

I predicted last week that the USPS was likely not in the position to force compliance with the regulation given the little time remaining to the election. That, combined with Judge Nichols decision leaves me quite certain that SCOTUS will not step in.
