I don't know how many times I have to say this, but the EU cannot do this, because they're all signatories to the European Convention on Human Rights. People cannot be sent back to places where they cannot be sure of a fair trial, to corrupt regimes, to places where, by being sent back, they may be deprived the right to a family life, and to places where they might be conscripted against their will. I say this not as speculation, or as my personal reading of the convention: these things have all been proved by European Court of Human Rights case law.

Britain has struggled to send literal rapists back to countries in which they may face (often quite nebulous) threats of persecution. British courts have refused to return to Jamaica a man who have committed a crime (or was it crimes?) in Britain, because he claimed to be homosexual, and said that social attitudes in Jamaica might lead to his persecution. We were unable to send a woman back to her home because she argued her child did not enjoy the food there. We could not return refugees to Spain (despite bring a signatory to the Dublin III agreement at the time) because the courts ruled that Spain might not be able to provide them with adequate housing.

Given Ukraine is notoriously corrupt, given the increasing b wrutality of the conscription process (as shown in countless videos free for all, including courts, to see), and given they are being sent back expressly to be conscripted against their will, it seems difficult to see how they would manage to return them while still pretending that we cannot return Somalians, Jamaicans, Sudanese, Syrians, Afghans and the rest who arrive illegally or who break the terms of their visas.

So, please, drive a coach and horses through these rules. Prove that they were nonsense the whole time. It would make the system fairer to British people. It would end the mockery being made of our legal system. You will never be able to tell us 'but dem's the rules' ever again. Great! But, more likely, they'll just appeal deportation and win their cases. Certainly in Britain they would.
