I’m still in disbelief that the prosecutors in Tory’s case blatantly stated in their opening statement that Justin Edison, Megan’s former bodyguard, would come testify in court that Tory confessed to him the day after the incident.

Tory’s appellate lawyers later said they could not find any records showing that interviews with Edison ever took place. There’s no evidence of out-of-court statements, no recordings — nothing to prove that Edison ever said this.

If no evidence ever existed, then telling the jury Justin Edison would testify to a confession was serious prosecutorial misconduct under Hawk v. Superior Court, which held that prosecutors cannot promise evidence in opening statements they don’t reasonably expect to produce; but if such evidence did exist and wasn’t disclosed, that would be a Brady violation.

That was highly prejudicial and disturbing, especially since prosecutors knew well before trial that Edison could not be located, to the point where the court had to issue a body attachment (essentially a bench warrant).

Where is the outrage about that? The media ran with the story, only for us to later learn there is no evidence of they speaking to Justin Edison whatsoever. How did they get that information? 🤔
