I love London, I have lived here my whole life and I am immensely sad to be writing this.
In the last week I have seen 4 phone thefts and tonight had my phone stolen by a bike gang for the 2nd time.
I pay $2M in taxes per year, the lawlessness is off the charts, the entrepreneurs have left, the taxes are higher than ever.
London is sadly falling.
I see a lot of debate around how UK Grooming Gangs weren’t “Asian” but Pakistani. Fair. The truth is - they weren’t driven by their Pakistani nationality/identity - they were driven by Islam. It takes some moral courage to truly articulate the problem adequately.

➡️ Validation of Notifications: Telangana High Court upheld the validity of Notification Nos. 13/2022-Central Tax and 09/2023-Central Tax, issued under Section 168A of the GST Act, for extending the limitation period under Section 73(10) to pass orders under Section 73(9). The court agreed with other High Courts that the term "in respect of actions" under Section 168A is broad enough to cover actions delayed during the COVID-19 period due to force majeure.
➡️ Invalidation of Notification No. 56/2023: The court invalidated Notification No. 56/2023-Central Tax, stating that it was issued without prior GST Council recommendation and only ratified six months later. It ruled that the "recommendation of the Council" is a mandatory prerequisite for issuing such notifications and that subsequent ratification cannot substitute this requirement.
➡️ Interpretation of Section 168A(1): The High Court clarified that Section 168A allows extension of time limits in three scenarios: limits "specified," "prescribed," or "notified" under the Act. It interpreted the phrase "under the Act" as sufficiently broad to include time limits extended by earlier notifications. Additionally, it emphasized that Section 168A(1)’s overriding clause permits such notifications to supersede other provisions in the GST Act.
➡️ Supreme Court’s Suo Motu Orders: The court dismissed arguments that the Supreme Court's suo motu orders during the COVID-19 period were confined to court or tribunal proceedings. It held that Section 73 proceedings are covered under these orders. The court noted the importance of punctuation in the SC’s order, ruling that the excluded period (15.03.2020 to 28.02.2022) applies to GST proceedings, rendering challenges to the validity of notifications largely academic.
➡️ COVID-19’s Impact on Limitation Period: The court acknowledged the extraordinary challenges posed by the pandemic and the necessity of extending limitation periods. It dismissed the relevance of data showing administrative challenges faced by the Revenue, stating such matters are beyond judicial review. It concluded that excluding the specified COVID-19 period from the limitation calculation renders the department’s actions timely and justified.
