Less than 48 hours after the declared Easter ceasefire ended, waves of drone and bomb attacks hit cities across #Ukraine, causing over 100 casualties.

Wizytacje BRPO na granicy z Białorusią wykazały, że SG nie dopuszcza pełnomocników zatrzymanych cudzoziemców – deklarujących wolę ubiegania się o ochronę międzynarodową w RP – do udziału w czynnościach prowadzonych wobec ich mocodawców. Nie są też im doręczane pisma i rozstrzygnięcia.
Pominięcie pełnomocnika strony jest równoznaczne z pominięciem strony postępowania administracyjnego. A postępowanie prowadzone z naruszeniem zasady udziału strony jest wadliwe.
Niepokojące jest również, że wobec cudzoziemców, którzy przy zatrzymaniu deklarują wolę ubiegania się o taką ochronę, wydawane są postanowienia o opuszczeniu Polski.
Takie praktyki są sprzeczne ze standardami Konwencji genewskiej, naruszają też art. 18 Karty Praw Podstawowych UE, art. 56 Konstytucji RP oraz ustawę o udzielaniu cudzoziemcom ochrony międzynarodowej – napisał Marcin #Wiącek w piśmie do komendanta głównego SG, w którym występuje o wyeliminowanie tych nieprawidłowości.
W odpowiedzi na pismo RPO komendant wskazał, że w ocenie SG pełnomocnicy ci nie są prawidłowo ustanawiani. Ponadto, od 1 stycznia 2023 r. do 15 września 2024 r. na polsko-białoruskim odcinku granicy państwowej SG przyjęła 3172 deklaracji oraz wniosków o udzielenie ochrony międzynarodowej w RP, którymi objęto 4088 cudzoziemców.
