📣 Big news from New York

Yesterday, the New York Board of Regents began backing away from its unconstitutional rule banning Native American names and images in public schools. That's a step forward, but the job isn't done.

On November 4, we'll be in front of the U.S. Court of Appeals for the Second Circuit, asking it to strike down the ENTIRE statute. Our argument is that it discriminates by race and violates the 14th Amendment.

If the Court of Appeals doesn't agree with us, we'll take our case to the U.S. Supreme Court. That Court has said many times that state laws that discriminate based on race are UNCONSTITUTIONAL, even when the reasons sound "good."

The NAGA Board and our Cofounder will be in New York with our attorney, Chap Petersen, for the oral arguments.

Thank you to everyone who has donated so far. Every dollar goes straight to our legal efforts. Taking this case to the Supreme Court will cost a lot, so we need your help to keep going.

May 5 is recognized as the National Day of Awareness for Missing and Murdered Indigenous Women and Girls (MMIWG) in the United States.

•It began in 2017 to honor victims like Hanna Harris and raise awareness of violence against Indigenous people.

•People wear red to honor victims.

•The color comes from the REDress Project, where empty red dresses symbolize those who are missing.

•Red is used because it is highly visible and represents the presence of those who are gone.

•Indigenous women face much higher rates of violence than other groups.

•In the U.S., they are about twice as likely to be murdered compared to the general population.

•More than 4 out of 5 Indigenous women experience violence in their lifetime.

•Thousands of cases go unreported or misclassified, meaning the real numbers are likely higher.

🦅 MAJOR UPDATE: NAGA Files 40-Page Reply Brief with Second Circuit Court of Appeals

We're pleased to announce that the Native American Guardian's Association (NAGA) and their VP, David Finkenbinder (Wanblee Ohitika - Brave Eagle) have officially filed our comprehensive 40-page Reply Brief with the United States Court of Appeals for the Second Circuit in Case 25-3221-cv.

This detailed brief clearly outlines our case against the New York State Board of Regents' discriminatory ban on Native American imagery in schools. We've presented strong constitutional arguments demonstrating how this law violates the 14th Amendment's guarantee of equal protection under the law.

Our Path Forward:

While we anticipate this appeal may be dismissed at the Second Circuit level, this is simply the next step in our journey to the United States Supreme Court—the only logical finish line for this case. When we reach the Supreme Court, we are confident we will prevail and strike down these offensive and plainly unconstitutional laws.

As our attorney Chap Petersen has said, "The 'Native Name Ban' laws are both offensive and plainly unconstitutional. Their very existence is an embarrassment to all Americans, as well as the Native community".

We need your continued support as we advance this historic case. This fight is about protecting Native American history, preserving our legacy, and ensuring equal treatment under the law for all Americans.

Stay tuned for updates as we continue our march toward justice at the Supreme Court! 🦅

‼️HEY—DID YOU KNOW….

From the battlefields to the Olympic arena, from the halls of Congress to the heart of our communities—Native Americans have stood proudly as part of the American story.

Our ancestors served as fearless warriors defending this land, later becoming revered Code Talkers who helped secure victory in World War II. Native athletes have represented our people and our country on the world stage, carrying the strength and spirit of our Nations into the Olympics. And today, Native leaders continue to serve in public office, shaping the future of this great nation.

Across generations and across landscapes, we remain one big family—Native Americans and all Americans—bound together by shared sacrifice, service, and pride in our homeland.

‼️For immediate release—Big news for NAGA’s historic lawsuit in New York‼️

The U.S. Department of Education has ruled that a Long Island school district violated federal civil rights law when it erased its Native American “Thunderbirds” mascot just to comply with New York’s state ban. Federal officials were clear: they will not allow ideologues to decide that some mascots based on national origin are acceptable while Native American ones are banned, and that equal treatment under the law is non‑negotiable.

This is exactly what NAGA has been saying from day one. New York’s so‑called “mascot ban” does not protect Native people – it singles us out and erases us while other identities and symbols stay in place. The federal government’s finding now confirms that forcing schools to drop Native imagery because it is Native is discriminatory under Title VI, echoing the 14th Amendment arguments at the heart of NAGA’s lawsuit.

As our case moves forward, this decision is a powerful boost. It shows that the fight to defend respectful Native names, imagery, and heritage is not only morally right – it is legally right. When NAGA wins in the Supreme Court, we will work community by community to restore Native representation that was wrongly removed and replace erasure with education, curriculum, and genuine partnerships with Native people.

This victory will belong to all Americans who believe in equal protection and honest history, not just Native Americans. Stand with NAGA, help us finish this fight, and ensure that Native identity is honored, not erased.
‼️As always, we cannot continue to fight this fight without your help. Please consider a donation to NAGA to offset our legal expenses. Here is our donation link 💰 https://t.co/SAefw5GHva

‼️Hey—did you know that national news outlets are sharing the story of NAGA’s fight? Word is spreading as NAGA’s battle continues.‼️

“We’re looking forward to the next stage in this journey to achieve justice and recognition for America’s first nations. We do need help to get there.” – Chap Petersen, NAGA Attorney

‼️Today, the historic NAGA lawsuit is reaching Americans across the country as national outlets like Fox News, the New York Post, and Newsday Today report on this critical fight for equal treatment and constitutional rights. This case is about more than images or logos – it is about whether Native Americans will be singled out and erased, or treated with the same dignity and respect as every other community.

NAGA is standing up not just for Native Americans, but for all Americans who believe in fairness, free expression, and the promise of the Constitution. When victory comes, it will set a precedent that protects every community’s right to honor their history, identity, and traditions.

To keep this fight going, NAGA urgently needs donations to cover the mounting legal expenses required to see this case through to the highest levels of the courts. Every contribution, large or small, is a direct investment in justice, recognition, and equal protection for America’s first nations and for future generations of students.

Godspeed to @Snide_Remarks, the hardest-working guy I know. Rick suffered a stroke Aug. 11 and died peacefully this afternoon. We were friends for 38 years, worked on many projects together, and rarely went more than a few days without staying in touch. I’m devasted by this loss.
