VICTORY in @adc case Pacheco v. City of Miami Beach! Earlier this year, the Mayor sent police to veteran Raquel Pacheco's house because she had criticized the Mayor's dehumanizing rhetoric against Palestinians on social media.

The cops refused to leave even though she said she didn't want to speak to them without a lawyer, insinuated her post could be unlawful as it could incite violence, and told her to refrain from posting such content in the future.

Today, the judge in the Southern District of Miami DENIED much of Defendants' motion to dismiss, finding that the police visit could constitute unlawful viewpoint discrimination and retaliation under the First Amendment. The judge also held we could proceed on our theory of municipal liability against the City, because we had alleged facts demonstrating a pattern or practice of discriminating against pro-Palestine speech in the City of Miami Beach.
