The recently notified Motor Spirit & HSD (Temporary Regulation of Supply through Retail Outlets) Order, 2026 reflects the Government’s commitment towards preventing diversion, hoarding and ensuring equitable availability of fuel across the country. The objective is appreciated and supported.
However, for effective and uniform implementation at the Retail Outlet level, certain practical clarifications would be extremely helpful:
• What are the exact specifications of a PESO-approved container?
• Will an official list of approved containers/manufacturers be circulated to dealers?
• How is a dispensing attendant expected to identify an approved container at the point of sale?
• Should customers be required to carry any PESO approval certificate, manufacturer’s approval number or supporting documentation?
• What action is expected if a container appears compliant but supporting documents are unavailable?
Further, the Order restricts HSD sales to a maximum of 200 litres per day per customer/vehicle.
Practical guidance may kindly be issued regarding:
• Whether the limit applies per vehicle, per customer, per transaction or per retail outlet.
• How dealers are expected to monitor cumulative purchases made from multiple outlets.
• Whether any centralized OMC-based software or monitoring mechanism will be provided.
• Treatment of genuine consumers such as farmers, DG set operators, telecom infrastructure providers, construction equipment operators and other essential service providers.
The Order also states that diesel procured under this provision shall not be resold and that OMCs and Retail Outlet Dealers shall ensure compliance.
In this regard, clarity would greatly assist the dealer fraternity on:
• The extent of dealer responsibility after lawful delivery of fuel.
• Documentation and records required to establish compliance.
• Measures expected from dealers to prevent future misuse by third parties.
• Standard operating procedures for field-level implementation.
Petroleum Dealers remain fully committed to implementing the Order in its true spirit and supporting the Government’s efforts to ensure uninterrupted fuel availability for genuine consumers. A detailed SOP and implementation guideline from MoPNG, OMCs, and PESO would enable smooth, transparent and uniform compliance across the nation.

Petroleum Dealers have been the backbone of India’s fuel distribution network, serving consumers through every challenge and circumstance. However, rising operational costs, increasing compliance requirements, manpower expenses, and stagnant dealer margins are creating serious concerns regarding the long-term viability of dealership operations.
I am exploring the possibility of organizing a peaceful Dharna at Jantar Mantar, New Delhi, to constructively highlight these issues before the Government, Oil Marketing Companies, policymakers, and the public.

The issue concerning vehicle fuel tank capacity is neither new nor disputed from a technical standpoint. SIAM (@siamindia ) itself, vide its communication dated 15.06.2015, categorically clarified that the fuel tank fitted in a motor vehicle is not a calibrated tank under Legal Metrology standards and that the declared fuel tank capacity generally represents only the usable volume. It further acknowledged the existence of additional volumes such as dead volume, expansion volume, filler neck volume, and variations arising from vehicle inclination, ambient temperature, and manufacturing tolerances.
The same communication also records that the actual quantity of fuel dispensed to a consumer is determined solely through duly verified fuel dispensing pumps, which are governed under the Legal Metrology framework.
Despite this settled technical position, petroleum dealers across the country continue to face complaints, inspections, nozzle closures, adverse publicity, and unwarranted harassment solely because consumers are often unaware that the actual fuel-holding capacity of a vehicle may exceed the advertised tank capacity specified by the manufacturer.
In the interest of transparency, consumer awareness, and avoidance of unnecessary disputes, SIAM and all vehicle manufacturers are requested to immediately issue a comprehensive public advisory clearly specifying:
• Advertised/usable fuel tank capacity;
• Maximum fuel-holding capacity including expansion volume and filler neck volume;
• Permissible variations due to design tolerances, vehicle positioning, and environmental conditions;
• Technical reasons why fuel accommodated during refueling may exceed the advertised tank capacity.
The continued absence of such disclosures creates avoidable confusion, unfairly tarnishes the reputation of petroleum retail outlets, undermines confidence in duly certified dispensing systems, and exposes dealers to unwarranted administrative actions despite there being no deficiency in the dispensing equipment.
We therefore call upon SIAM, OEMs, Oil Marketing Companies, the Ministry of Petroleum & Natural Gas, and Legal Metrology authorities to issue suitable clarifications and standard operating guidelines at the earliest.
Failing such intervention, petroleum dealers and their representative bodies may be constrained to pursue appropriate legal remedies before the competent judicial and regulatory forums for protection of their lawful business interests, reputation, and rights against arbitrary actions arising from technical misconceptions that have already been acknowledged by the automobile industry itself.

@cmdbpcl@BPCLimited The supplies of Brij Auto ( Sikandra) Agra HSD site CC 115466 has been blocked by TM Agra Territory Office @deepak7480 falsely citing a issue in PESO License whereas there is no order from PESO to suspend the supplies.
The officers are unable to understand a simple legal situation that the lease agreement and dealership agreement are two different agreements indistinct of each other and harrassing the dealership to convince the family members to execute a lease for peanuts.
The matter is under adjudication and harrassing a dealer in such circumstance is totally unwarranted.
Further , the dealer has all rights to know by means of which order the supplies have been blocked by Agra Territory office.
If you cannot give supplies atleast provide an order by means of which supplies are blocked.
Further if you think by adopting to such means you can convince a family to lease, you are completely on the wrong path.

@IndianOilcl It is really astonishing to note that inspite of not finding any malpractice or irregularity you have illegally proceeded to suspend the sales from concerned nozzle. Prima facie it is apparent that you have SUCCUMBED to media pressure and instead of standing next to your dealer you are acting arbitrality.
By suspending the sales from concerned nozzle you are motivating public at large to create such technical frivolous issues and public will forthwith demand closure of sales from concerned nozzles in future too. How many nozzles would you close?
It was better if you would have come up with legal and logical explanations which would have put an end to the issue.
By Suspending the sales without any fault of dealer you have not closed the issue instead you have opened Pandoras Box which would invite similar situations in future too.

• No public restriction order has been announced.
Then on what grounds are dealers being informally targeted or monitored?
Either there is a supply concern, or there isn’t.
Which one is it?
Because right now the messaging looks confused:

• OMCs keep posting “No Shortage, No Restriction” on social media.
So what is the actual truth?

Petroleum Dealers across India need to seriously introspect the current viability of Retail Outlet operations.
The numbers clearly show the reality:
2018 Scenario:
MS Margin: 4.31% on ₹76.56
HSD Margin: 3.28% on ₹70.00
2026 Scenario:
MS Margin: 3.94% on ₹98.96
HSD Margin: 2.56% on ₹92.09
Despite fuel prices continuously rising, dealer margins in % terms are continuously shrinking.
What Dealers have actually suffered:
• Capital erosion
• Margin erosion
• Huge increase in manpower cost
• Higher electricity & operational expenses
• Increased compliance burden
• Bank interest & finance cost escalation
• Rising competition due to excessive RO saturation
Today, Retail Outlets are surviving on volume, not profitability. Fixed per-litre margins are no longer sustainable in the present economic environment.
If fuel prices continue to rise further while dealer commissions remain stagnant, the day is not far when Dealers will have to fund operations from their personal savings merely to keep outlets functional.
Therefore, there is an urgent need to shift Dealer Commission from “per litre basis” to a “percentage linked model” so that dealer sustainability moves proportionately with inflation and fuel pricing dynamics.
If legitimate concerns of Dealers continue to remain unheard, then Petroleum Dealers across India must collectively consider:
• Smart operational restructuring
• Curtailment of operational hours
• Weekly offs for Retail Outlets
• Cost optimisation measures
No business can survive indefinitely with rising liabilities and declining real margins.
This is not merely a demand — it is a question of survival, sustainability and operational dignity for thousands of fuel retail entrepreneurs across India.
