The provision of changing and lavatorial facilities by an employer is governed by the Workplace (Health and Safety) Regulations 1992. Employers are required to provide separate facilities for males and females. There is no option to provide only mixed facilities. Mixed facilities are optional but sex-separated facilities are compulsory. That has been the case for 34 years. It has not changed because of a Supreme Court Judgment. You might not have understood it before, but you do not need EHRC Guidance to understand it now. Fire fighters must be provided with biologically separated sanitary and changing facilities. That will remain the case even if the EHRC Guidance is frustrated.
No "hard-won" rights have been rolled back. The rights you imagine (or, more likely, have been briefed about) have never existed. Rights do not accrue and acquire validity thanks to magical thinking or bad advice.
That which you frame as a call for employers and service providers to "go beyond minimum requirements" is, in fact, a demand that they break the law. I assume you had no idea that was the case. I can imagine you being keen to change laws with which you disagree, democratically, but I should be surprised were you to knowingly call for outright anarchy.
The laws governing access to legitimately sex-separated facilities have not changed for employers since 1992, and for service providers since 2010. If you were ignorant of them before you have no excuse now. If you do not like them you may seek, democratically, to change them.
Until then, I strongly encourage you to urge members to obey the law and stop posturing as though the law is something you might like it to be but is not.

Fearing he would target others, she exposed the man publicly. Out of fear, he handed himself in and was remanded.
But on appeal, he was released. He is now bailed until a court date in 2027.

Today, I was given a permanent ban of posting on my Facebook page, @Meta. The page can exist - apparently - but I am not allowed to post on it anymore. The page has been deemed controversial due to the Giggle v Tickle case and increased popularity of 25,000 new followers in a week. I don't want to labor the irony of being banned on a social networking platform while fighting in court for the right to ban men from a woman only social networking platform, it is what it is. Frankly, I'd love to have the same right that you do, @Meta.
Women are routinely punished for not accepting men as women. It doesn't turn those men into women. Nothing will.

The Full Federal Court has handed down its judgement in Giggle v Tickle.
In a shock to women across the country - Sall Grover not only lost her appeal, the Court set aside the original finding of indirect discrimination and replaced it with direct discrimination, upholding Tickle's cross-appeal.
The damages were doubled from $10,000 to $20,000.
It’s important to note the Court expressly said it was only applying the Sex Discrimination Act as it is written- it is "not empowered to give effect to its own view" about whether that law is desirable.
In 2013, @JuliaGillard’s @AustralianLabor government amended the Sex Discrimination Act- stripping the meaning out of "man" and "woman" and adding gender identity as a protected attribute to be pitted against biological sex.
Today's outcome is proof of what those amendments have done: women are left with no meaningful rights or recognition under the Sex Discrimination Act - a bitter irony, given that protecting women was the very purpose of the Act under our commitment to CEDAW.
In my opinion, this is a verdict on the law, not on Sall. The judges found that the law - as that government amended it - left them no other conclusion.
These amendments must be repealed.
The Sex Discrimination Act must once again recognise biological reality and protect women's right to single-sex spaces.
What a dark and devastating day for Australian women and girls.

The introduction of female only private spaces into society was so that women & girls had the opportunity to participate in society. Theyre necessary for this. To this day, developing nations are focusing on ensuring there are girls bathrooms at schools as something so simple is essential to girls actually going to school & getting an education. When girls have an education, the quality of the entire society lifts. There is research & data on this. Or, there was. The vast majority of the research was done prior to 2018. Then, rather suddenly, the literature changed to how important “inclusivity” is. Absolutely none of the issues facing women & girls changed. As organizations & institutions started to wax lyrical about “inclusivity”, it quickly became clear that it basically was a buzzword to disguise the reality: males in female spaces. So, many women said “no” as “inclusivity” required women & girls to give up something still necessary to us: female only spaces. Additionally, it turned the places we’re supposed to expect single sex safety into… just another unisex space. There is a negative impact on women, girls & society to remove female only spaces & we’re not willing to let that happen.
For the better part of a decade the demographic you refer to as “trans” has had unprecedented political capital & could have cashed that in for specific safety & privacy needs. Anything they wanted and needed, they could have had. But they didn’t demand anything for their specific needs. Instead, the focus was primarily on “inclusivity” aka getting males into female spaces, taking away the safety & privacy of one group to validate the identity of another. It’s an odd demand if safety & privacy for “trans” was at all the priority. But of course, it was never the priority. Letting men go into female spaces was always the priority.
Now, all the while, many people have called women like myself who want female only spaces “bigots” or told us that we’re “obsessed with genitals” by simply stating that men cannot be women & therefore aren’t allowed in female only spaces. But we’re not the ones who specifically brought “genitals” into the discussion, the ones demanding that women can have a penis did that.
HE PROTECTED 54,000 DOCTORS. THE @NHS PROTECTED ITSELF.
In January 2014, Dr Chris Day (@drcmday) was working overnight in the intensive care unit at Queen Elizabeth Hospital in Woolwich. Two locum doctors didn't show up. The unit was running at double the patient load the national guidelines allow. He raised the alarm. He reported unsafe staffing. He linked the situation to two patient deaths.
That's what the NHS calls a whistleblower.
What followed was eight years of litigation, a legal battle all the way to the Court of Appeal, and over £700,000 of public money spent by Health Education England (@NHSE_WTE) and Lewisham and Greenwich NHS Trust (@LG_NHS) trying to stop his case being heard at all.
Here's the really elegant bit. HEE's opening legal argument wasn't that they'd done nothing wrong. It was that whistleblowing law simply didn't apply to them, because they didn't directly employ junior doctors. They were just the organisation that controlled the career progression of every single one of England's 54,000 junior doctors. Totally different thing.
Dr Day fought that argument to the Court of Appeal and won. The law was clarified. All 54,000 junior doctors below consultant grade in England now have statutory whistleblowing protection. One man, crowdfunding against three QCs, changed employment law for an entire profession.
No formal apology from the NHS. No reinstatement. No path back to a consultant career. He has worked as a locum A&E doctor ever since, doing overnight shifts while his opponents collected salaries, pensions, and the occasional glowing tribute to NHS transparency.
During the 2022 tribunal hearing, the communications director at Lewisham and Greenwich NHS Trust deleted up to 90,000 emails. The director whose entire NHS email archive was also deleted during live litigation happened to be the instructing legal client in the case. The tribunal described the conduct as extraordinary. Nobody was prosecuted. The trust issued a partial apology about a press release.
The system did exactly what it always does. It absorbed the cost, deflected accountability, and waited for the man it destroyed to run out of money or energy.
He hasn't.

BBC BROKE EQUALITY LAW AND GOT CAUGHT
Carrie Gracie spent 30 years at the @BBC. She spoke fluent Mandarin. She ran the Beijing bureau. She was one of four international editors, two men and two women.
Then in 2017 the BBC was forced to publish salary data. Gracie looked at what her male equivalent, the North America editor, was earning. He was on nearly double her salary. She had explicitly said equal pay was a condition of taking the China role. The BBC agreed. Then quietly paid her far less anyway.
She asked for equal pay. The BBC offered her a raise that still left her below the men. She turned it down. She resigned from the China post in January 2018 and published an open letter telling the licence fee public exactly what their broadcaster was doing.
The BBC then put her through nearly a year of an internal grievance process that went nowhere. It took three meetings with the Director-General and the threat of an employment tribunal before she got a public apology and the backdated pay owed to her. The total came to £361,000.
She donated every penny to the Fawcett Society (@fawcettsociety), the gender equality charity. She said the fight was about principle, not the payout.
A publicly funded institution, legally obligated to follow equality law, paid women less than men in identical roles, got caught, dragged it out for a year, and only coughed up under threat of a tribunal. That is not a pay oversight. That is a policy.
Gracie did not ask for a favour. She asked for what she was owed. The BBC made her fight for it like it was a privilege.

My choir - which specialises in singing at charity running events - has been dropped from Sunday's London Marathon.
Because I don't believe people can change sex - and said so publicly.
We were dropped by the disability charity Scope - who we've supported for the past two years - on the basis of two anonymous complaints. About MY gender critical beliefs.
So not only am I being discriminated against due to my lawfully held views - so are other people.
After months of preparation ... disappointed is not the word.
Suffice to say, if there are any organisations out there who are happy to welcome volunteers with lawfully held beliefs on sex and gender, we'd love to be your 'cheer squad' at Sunday's London Marathon.
Our running themed 'set list' is always a hit with runners and we bring fun, enthusiasm and props in spades (hence the 'Eye Of The Tiger' mask).
We'd love to help support runners raise money for good causes at this year's London Marathon - as we have done in previous years.
