WHY HASN’T FARUQUI BEEN CHARGED UNDER 18c ?
I advised Pauline Hanson that she should have make a counter-claim that Faruqui had violated 18c - as there was no better way to defend the case and illustrate the absurdity of this law.
Unfortunately, she didn’t take my advice.
If you look at the provisions of 18c, Faruqi’s comments (within hours of the Queen’s death) are a clear violation of the Act.
For "some or all” of a "group of people" being people of British "national or ethnic origin" were "reasonably likely" to be "offended or insulted" by Faruqui’s "act" of publicly tweeting;
"I cannot mourn the leader of a racist empire built on stolen lives, land and wealth of colonised people".
I would encourage Pauline Hanson to appeal and include a cross-claim.
And for avoidance of doubt, I believe that 18c should be scrapped.
Two sitting Senators with Parliamentary privilege and large social media followings should be able to engage in vigorous debate on all political issues.
Hanson’s comments simply hi-lighted Farqui as an upper hypocrite - someone enjoying the luxury & privileges of a Senator in a Westminster Parliamentary system, and enjoying all the benefits & freedoms that Australians have inherited from the British Commonwealth - while insulting that very Commonwealth.
Hanson was right, if she’s not happy and thinks Australia is such a terrible place - she should pack her bags piss off back to whichever country she same from.
