What the KRA’s 2026 e-Invoice Rule Means for You:
1. What’s the new rule?
From January 1, 2026, KRA requires that every expense you use in your tax return must be backed by an approved electronic invoice (referred to as “eTIMS” or “TIMS”).
If you claim you spent money (for example rent, materials, services, equipment), but you don’t have a valid e-invoice, KRA will treat that money as if it was income, meaning you’ll be taxed on it.
The rule applies even if you’re not VAT-registered. Even small vendors, landlords, tutors, service providers are affected.
2. Why is KRA doing this?
KRA is matching what you report with what your suppliers report via their electronic invoices, plus import and withholding-tax records.
The goal: prevent people from deducting fake expenses, or reporting lower income than what the system sees. If the supplier didn’t issue the e-invoice, the expense is unverified.
For example: if you claim you bought goods from Supplier A, KRA will check if Supplier A’s eTIMS records show the same sale to you. If not, you’re in trouble.
3. How does it affect you or your business?
If you run a business (small, large or informal), you must demand eTIMS receipts from anyone you buy goods or services from.
If you receive payments and issue receipts (for example you’re a landlord, service provider, tutor, mechanic, etc.), you must switch to electronic invoices so your clients can use their expense claims.
If you fail: Suppose you claim an expense of KSh 360,000 (e.g., rent), but the landlord didn’t issue an eTIMS receipt. KRA will treat that KSh 360,000 as additional profit/income to you, and tax it accordingly.
For small businesses relying on informal suppliers (who don’t issue eTIMS receipts), the consequence is higher: either switch to formal suppliers (often more expensive) or risk losing the deduction and paying more tax.
4. What kinds of transactions are covered?
Rent paid for offices or shops (landlord must issue eTIMS invoice).
Goods purchased (raw materials, equipment).
Services paid for (cleaning, repairs, labour, tuition, etc).
Side-hustle incomes (freelancers, tutors, mechanics) must issue eTIMS invoices if clients want to deduct the cost.
Even non-profits, clinics, schools need to make sure their suppliers issue eTIMS if expenses are claimed.
5. What will happen if you ignore this?
KRA will add unverified expenses back into your income, increasing your taxable income.
You could face audits, penalties, unexpected tax bills.
If your supplier doesn’t issue an e-invoice, you might lose clients (if you’re the supplier) or lose deductions (if you’re the client).
It may cause costs to go up (formal suppliers may charge more), which could pass to consumers.
6. What should you do now?
Start asking your suppliers: “Do you issue eTIMS receipts?” If not, you may need to switch.
If you’re issuing invoices, upgrade to the eTIMS system so your clients can use your invoices.
Keep your records: save every e-invoice, invoice number, PIN of the supplier, date, amount.
If you currently operate informally, consider formalising: register for eTIMS, get tax PINs, adopt digital accounting.
Talk to your accountant or tax advisor now — don’t wait until the deadline.
