@jeremy_gans If he was dealt with by way of Future CAN then he never had to appear today in any event (in person, by AVL or otherwise) so I’m not quite sure what the Magistrate was so concerned about…
@jeremy_gans It’s never been clear to me if he received a Future CAN or was arrested + charged. If the latter then he’s likely on bail (but apparently with no bail conditions) in which case he would have needed to attend in person on the first date in accordance with his bail acknowledgement.
@LawyerMelbourne And for further context in relation to the recent NSW case of DB, the Crown's application for special leave to appeal the NSWCCA's decision to the High Court was refused in December 2022.

@BabbyUnit It’s also worth noting how many of these cases come down to a dispute over lack of consent (or the accused’s knowledge of lack of consent), rather than outright ‘no sex happened.’ In such cases it wouldn’t ordinarily be suggested that the complainant is lying.
@jeremy_gans His comment about still holding a view there were reasonable prospects of conviction also seems dangerous. It’s such a low threshold but this is only really understood by lawyers. It seems to elevates the strength of the evidence unnecessarily and unfairly.
@jeremy_gans If a Director is to make comment on behalf of either party (which he shouldn’t), he should at least refer to this. The presumption of innocence will forever remain intact in this case. So fundamental, yet so readily overlooked in this case from start to finish.
