Cardano just vibe authored a replacement constitution and dreps accidentally just pushed it straight to production rather than reading or reviewing it.

It concerns me that the discussions being had around the constitution are focused on a supposed balance of power between the CC and DReps. This is the wrong framing to me.
The balance is between ada holders and the constitution. Without a constitution there are no constraints on the freedoms of ada holders (other than what is technically possible at the protocol level).
My personal opinion (understanding that others may have differing views) is that the default should be total freedom. So we should carefully decide the bare minimum set of constraints that need to be applied through the constitution, to prevent those with more voting power from taking control.
The suggestion that the Constitutional Committee has some degree of unchecked power is misleading. Unintended “power” for the CC only comes if they can leverage ambiguity in the constitution to make a determination that is different to what the constitution intended.
So given the power exists within the constitution itself, there needs to be a constraint within it that prevents ada holders with sufficient voting power from rewriting it to remove other constraints they don’t like.
Regardless of what form this constraint takes, it should in my opinion be the most important. The presence of all other constraints are negotiable, as once agreed their ability to be retained is inherited from the first constraint.
Like it or not, the most recent change exploited a weakness in the original constitution, to replace it with an even weaker version. The question now is whether it is possible to put the genie back in the bottle, or will DReps like having the ability to remove constraints when it suits them?
