Key SCOTUS rulings:
Tennessee v. Garner (1985): Deadly force against fleeing suspect unconstitutional unless officer has probable cause suspect poses significant threat of death/serious harm to officer/others.
Graham v. Connor (1989): Use of force judged by "objective reasonableness" under 4th Amendment, based on facts known at time—not hindsight.
DHS Policy (Management Directive 044-05): "Fleeing Subjects: Deadly force shall not be used solely to prevent the escape of a fleeing subject. However, deadly force is authorized to prevent the escape of a fleeing subject where the LEO has a reasonable belief that the subject poses a significant threat of death or serious physical harm to the LEO or others and such force is necessary to prevent escape."
@Deevoee@LDS_Dems ICE and CBP follow use-of-force guidelines that align with constitutional standards from Tennessee v. Garner, emphasizing objective reasonableness rather than blanket permissions for fleeing subjects.
I regarded Senator Lindsey Graham as a warmonger...and I stand by that assertion. He did, however, have many redeeming qualities, as Justice Elena Kagan points out. Rest in Peace, Senator Graham.
JUST IN: Supreme Court Justice Elena Kagan pays tribute to the late Senator Lindsey Graham, recalling how the South Carolina Republican crossed party lines to support her nomination to the high court.
During her opening remarks she expressed condolences on behalf of herself and the Supreme Court, saying she understood why so many people would deeply miss Sen. Lindsey Graham.
"I want to express my gratitude towards him, not only for his support, but for, approaching the confirmation process, with the kind of seriousness that he did. and and the kind of respect he did."
“I never got to know Senator Graham very well, but I can see why so many people will deeply miss him.”
Tell me you know absolutely nothing about the market economy, economics in general, and capitalism without telling me you know absolutely nothing about these things.
Hint: "Democratizing the economy" means replacing price signals and voluntary exchange with political control. Evidence from history—USSR, Venezuela, Maoist China—shows this reduces innovation, growth, and living standards versus market economies.
My daughter has expressed similar concerns about hypocrisy in the Church, although on different matters. I love my daughter unconditionally and I know Heavenly Father and Jesus Christ love all of us unconditionally. Similar to what I tell my daughter, I hope and pray that you find the answers you are looking for.
When Senator Lindsay Graham arrived at the pearly gates, he looked up at St. Peter and said, "It's about time we kicked the Devil's ass! I think we should invade Hell!!"
