BREAKING:

A suspect linked to the murder of a woman whose body was discovered at Mooifontein Cemetery in Tembisa on Saturday morning has been arrested.

It is alleged that following the murder, the suspect fled to Tzaneen, Limpopo, where he was apprehended by police on Saturday evening at approximately 23:00.

The investigation and tracing of perpetrators linked to other women's bodies found in Ekurhuleni is still underway with police following all available leads.

Bafana Sindane was supposed to sit before the Madlanga Commission today.

He asked for a postponement. The chairperson said no — attend first, argue later.

At 09:30 this morning, his postponement application was heard. He was required to be there regardless of the outcome.

​​The real move is not the postponement.​​

It is the urgent High Court application filed yesterday: stop the commission from using or publishing evidence extracted from his cellphone. Specifically the WhatsApp material.

That is different from Suleiman Carrim's case in February. Carrim tried to block the subpoena itself. Lost. Johannesburg High Court struck it off the roll.

Sindane is not refusing to come. He is refusing to let his phone testify against him.

​​Same legal team. Same strategy.​​

Joe Ferrari Sibanyoni already made the same objection at the commission — using cellphone data from a pending criminal case is an "absolute abuse" of privacy and constitutional rights. He reserved the right to go to court. Sindane went first.

If Sindane wins, Ferrari benefits. If Ferrari wins later, Sindane benefits. The two cases are legally symbiotic.

​​What is on that phone matters.​​

The Rule 10.6 notice covers:

- Links between Sindane and Sibanyoni.
- Connections to the late Jothan "Mswazi" Msibi.
- Alleged police contacts.
- WhatsApp chats already put to Ferrari: references to izinkabi, "the dog is dead," "we are in charge of the streets."
- Financial flows — stokvels, payments between the two men.

The commission does not need Sindane to confess. It needs the messages to be admissible.

​​The criminal case sits behind all of this.​​

Sindane and Ferrari are out on R70,000 bail each in Delmas, facing extortion and money-laundering charges. The state alleges they forced a mining businessman into paying protection fees exceeding R2.2 million between 2022 and 2025. They deny the charges.

The phone was seized in that criminal investigation. The commission is now trying to use the same material in a public inquiry.

That is why the High Court application exists.

​​Why the commission is pushing.​​

Madlanga said Sindane must attend even if the postponement application succeeds. That is not impatience. It is urgency.

The commission wraps public evidence in early October — roughly two weeks from now. Final report due 25 January 2027. If Sindane's testimony slips past the October window through a combination of court applications and postponements, he may never testify in public at all.

Delay is not stalling. It is strategy.

​​The stakes.​​

Carrim tried to block his subpoena and lost. The court affirmed the commission's power to compel testimony.

Sindane's application is narrower — not "I do not have to come," but "You cannot use what is on my phone." That is a harder question. The commission has broad powers, but using evidence seized in a separate criminal case does raise self-incrimination issues.

If the High Court sides with Sindane, a significant portion of the taxi syndicate evidence becomes unusable.

If the court sides with the commission, the WhatsApp messages enter the record — and the messages Ferrari called ambiguous suddenly have context.

Here is what we will know soon: whether "attend first, argue later" was the commission's last word — or the beginning of a court fight that could reshape how the Madlanga Commission uses digital evidence.
