TEN YEARS IN AMERICA, AND NOW ICE HAS COME KNOCKING!
Federal immigration agents arrested German Machado Guillen, a SUNY Brockport IT technician from Venezuela, outside his home in Batavia, New York, Tuesday morning.
And already, we’re hearing the familiar narrative about a hardworking man, a family, and an asylum application.
But there’s another side to this story, and it comes directly from the Department of Homeland Security.
According to DHS, Machado entered the United States legally on August 30, 2016. His authorized stay expired February 27, 2017.
That was nearly a DECADE ago!
His wife says the family applied for asylum in 2016, that their case remains unresolved, and that her husband had authorization to work.
Now here’s where people need to understand an important legal distinction.
WORK AUTHORIZATION IS NOT THE SAME AS LAWFUL IMMIGRATION STATUS!
DHS says Machado remained in the country beyond his authorized stay and is now being held pending immigration proceedings.
But there’s also a disquieting question here.
If this family applied for asylum in 2016, why was the case still unresolved ten years later?
TEN YEARS!
What exactly has our immigration bureaucracy been doing?
Because two things can be true simultaneously. A person can have authorization to work while an asylum application is pending, and that authorization does not necessarily establish lawful immigration status.
Furthermore, an unresolved asylum application is not, by itself, proof that someone has committed a crime.
DHS says Machado will receive due process. That’s important, because the facts of his immigration case, including the status of his asylum application and any available legal protections, deserve examination.
SUNY Brockport confirms that the college is in contact with his family but has declined further comment, citing personnel privacy.
The real questions are straightforward.
Why did an asylum application reportedly remain unresolved for ten years?
What was Machado’s precise immigration status when agents arrested him?
And what legal determination, if any, had already been made concerning his right to remain in the country?
I want immigration laws enforced. I also want the government to follow those laws correctly.
That’s not a contradiction. That’s what the rule of law requires.
