In addition, the telecom company Ennetcom was acquitted of the charges of membership in a criminal organisation and money laundering.

Who stands to gain from a plea deal with the prosecutor in crypto phone/ pgp evidence cases: the defendant or the attorney? I wrote a column on the subject.
The Court accepted the defence position that an attachment or seizure order does not alter ownership of the asset. Consequently, the individual retains full standing and all procedural rights to participate as a private prosecutor in the proceedings. The collaboration in this case is a perfect example of the importance and value of the @IntercrimeDA alliance.

The Provincial Court of Málaga (Audiencia Provincial) has allowed the appeal filed on behalf of our client and has quashed two prior rulings of the Investigating Judge in a high-profile criminal case in Marbella.

The Investigating Judge and the Public Prosecutor had denied our client the right to appear as a Private Prosecutor (acusación particular) alongside the Public Prosecutor, on the grounds that a crypto wallet exceeding €11 million – seized during a search of the client’s residence pursuant to a Dutch judicial order – had become public property, thereby making the State, rather than the individual, the sole injured party.
Hereby I share my report on the methods, techniques, and parties involved in the EncroChat and SkyECC hacks.
I wrote this because I have noticed that there is an information deficit among defense teams, which makes it difficult for them to properly interpret and refute the often incorrect or incomplete positions taken by prosecutors and law enforcement.
