In response to the recent actions of MA Attorney General, Andrea Campbell, regarding the proposed shelter at 1 Love Lane, our organization has issued the press release below:

CCCC CALLS FOR MA ATTORNEY GENERAL TO
CEASE INTERFERENCE IN TOWN GOVERNMENT
Cape Cod Concerned Citizens is very concerned about the interference of the Massachusetts Attorney General’s office in the Town of Dennis zoning matter known as 1 Love Lane. This property, formerly known as Eagle Pond Nursing Home, was purchased by Housing Assistance Corporation (hereinafter “HAC”) so that they could convert it to a homeless shelter. To achieve this end, HAC filed for a permit with the Town of Dennis under what is known as the Dover Amendment. This amendment is granted when an organization will use the facility as a primarily agricultural, educational or religious purpose. This process also allows the organization to essentially bypass all of the usual town board approvals needed for permitting. The Town of Dennis Planning Board rightly believes that HAC’s use of this facility is not primarily for agriculture, education or religious purposes but it is primarily a shelter use. Several months ago, HAC served the planning board members with a threat of legal action against them individually because of their stance concerning the Dover Amendment exemption. To their credit, the planning board has not backed down and has continued their actions to have HAC follow the normal procedure for the permits. HAC has not accepted this decision of the board and has now employed the intimidation of the Massachusetts Attorney General’s office to force the Town of Dennis into compliance.
Also, even though the only access to 1 Love Lane is from the Town of Harwich, HAC has completely left them out of the process. Harwich will be affected by this shelter by way of increase of emergency services, traffic, schooling etc. The Harwich select board has approved an independent traffic study and other actions to protect their town.
The towns of Dennis and Harwich requested a regional impact study by the Cape Cod Commission, but that request was denied with very little discussion among the commission members.
We believe that there is a conflict of interest between Alisa Magnotta, CEO of HAC and Maura Healey in that Magnotta has donated to Healey’s campaign several times (per OCPF) and she appointed Magnotta to the Affordable Abundant Housing Committee. We see a further conflict of interest in that Magnotta is a board member of the Cape Cod Commission Barnstable County Economic Development Council.
Under the Healey administration, we see the use of intimidation and threats to our towns, whether it is for permits for these types of projects, for the numerous 40B housing projects or MBTA Communities projects. We believe that the heavy hand of state government is unconstitutionally negating towns’ rights to govern themselves. It is authoritarian in nature and we call on the Healey administration and the Attorney General to cease these activities immediately and allow our towns to independently govern themselves without the over-bearing interference of state government.
