Kenya’s Basic Education Bill 2026 just dropped, and it’s not the “free education” fairy tale they’re selling.
Read the actual clauses:
Clause 28(10): A person who promotes or manages a basic education institution without a registration certificate 👉 up to KSh20 MILLION fine or 3 years in prison, or both. The institution can also be closed.
Clauses 11 & 12(4): Contravening the rules on tuition fees or other charges → up to a KSh1 MILLION fine or 3 years in jail, or both.
Clause 16(2): A person who prevents a child from attending school because of employment, income-generating activities, parental conflict, cultural practices or another ground → up to a KSh5 MILLION fine or 5 YEARS in prison, or both.
And there’s more:
Clause 17(2): A parent or guardian who fails to ensure a child regularly attends school 👉 up to KSh100,000 fine or 1 year in prison, or both.
Clause 18(3): A parent or guardian who, without reasonable cause and after a written notice from the school, fails to comply 👉 up to KSh200,000 fine or 2 years in prison, or both.
They call it “protecting free education.”
I call it criminalising poverty.
Thousands of low-cost schools and community education centres could face serious consequences if they operate without the required registration.
Parents already struggling will face criminal penalties for failures relating to their children’s school attendance.
School heads and parents need to read this Bill carefully.
This is not reform.
This is a war on the poor dressed up as progress.
The Bill is still in Parliament. Public participation matters.
Parents. Teachers. School owners. Read the Bill. Speak up.
🚨 BREAKING: Kenya's new Protests & Picketing Bill has been published.
At first glance, it looks progressive.
✅ Protest notices can be sent via email, WhatsApp, in person, or even posted at a police station.
✅ Police would be required to protect protesters, journalists and medics, even during spontaneous protests.
✅ Plain-clothed officers would be limited to intelligence gathering.
✅ Firearms would only be a last resort.
But then you read the fine print.
Protest organizers would still have to notify police 14 days in advance and provide their full identity, phone number and contact details.
Here's the question every Kenyan should ask:
If people fear being profiled, intimidated or arrested after identifying themselves, will they still feel free to submit notices to organize a protest?
Because the police will end up targetting those who submit notices.
Another question: Who defines "last resort"? What objective test will determine that every other option has truly been exhausted?
And if plain-clothed officers are still allowed at protests, what changes in practice? What prevents them from abducting or shooting protesters ??
This legislation in my opinion is extremely weak & gives police even more laws to hide behind as they harm protesters
Rights don't disappear only when they're banned. Sometimes they disappear when exercising them becomes too risky.
The Bill is now headed for public participation.
The bill seems to solve nothing significant on matters police brutality .
A letter notifying the police of today’s peaceful march to Parliament marking the second anniversary of June 25th and stating that Kenyans will be marching countrywide, was delivered to Police Spokesman Michael Nyaga Muchiri by five lawyers.
Here is the video we recorded as the letter was handed over in the presence of former Chief Justice Willy Mutunga, former Justice Minister and Senior Counsel Martha Karua, Professor of Law and Senior Counsel Kivutha Kibwana, Senior Counsel Gitobu Imanyara and Senior Counsel James Orengo.
The police had sufficient time to prepare to protect marchers and ensure that no goons infiltrate to harm protesters or loot businesses.
It is the duty of the police to protect lives and property for all and to arrest criminals. If any goons appear today and are not arrested, we shall know they are working for President Ruto.
