I highlighted the attempt to ReAllocate Kes 1.5 B from Coffee subsector Coffee Cherry Advance Revolving funds by PS Ministry of Cooperatives and SMSE through a letter dated 22/08/2024 addressed to the PS Treasury.
The letter sought to remove Kes 1.5B from the Fund from which Farmers borrow as seasonal Loans and give it as Grants to suspicious/non existence saccos and women groups Outside coffee sector.
Article 223 of COK together with section 43 of the Public Finance Management Act 2012 and Regulation 40 of the Public Finance Management Regulations 2015 only the Accounting officer of the KPCU who is the CEO/Managing Director is legally authorized to reallocate funds within his budget lines, to the limit of 10% to and from an item/purpose.
But as per PFM act section 43 (1) ( a) (Cap 412) you cannot re-allocate Funds that are appropriated to be transferred from one government agency or entity.
Conditional and reinfenced funds like cherry fund cannot be reallocated for political reasons.
Acts like these are abuses of office and outright violations of the constitution and the PFM Act.
Vehemently denying the attempts through flying letters only potrays the hidden motives to frustrate the coffee reforms underway so as to depict some leaders ineffective .
Unfortunately, this is playing political hide and seek at the expense of the naive coffee farmers.
This is complemented by the unkept promises of disbursing the first bunch of Kes 2B allocated in 2023 finance budget.
Dear @Ps Dr Kiptoo NT and PS Patrick Kilemi MC, where is the evidence that the 2B Cherry Funds for 2023 financial year was disbursed to NKPCU?
Out of 2B you only released 600 Million. Where is the Balance?

The MPs are active in that disagreement because they are the pipes by which money flows out.
