@UnrealizedPains@CoachDuggs Once again, the judge would never give a legal ruling on something not in the case. He may have said they can try to sue for that, or that he can’t rule on that for this specific case. But he definitely didn’t tell them it should be a loan.
@UnrealizedPains@CoachDuggs You literally said “the judge confirmed it should be a loan”. Obviously that didn’t happen, and it’s misrepresenting this as well. It’s his lawyers believing they could still fight it because the Judge didn’t outright say “it’s not a loan”.
@UnrealizedPains@CoachDuggs You sent a quote from his lawyer saying the Judge said it should be considered a loan. Obviously, like you’re saying now, that didn’t happen.
@UnrealizedPains@CoachDuggs So the judge ruled on something he procedurally couldn’t rule on? But only to let them know they could file another lawsuit that, if they get this judge, are now guaranteed to win?
@UnrealizedPains@CoachDuggs Again, because it’s an investment, the timing of the income can be argued with the IRS. However, it’s not a loan. And if the Judge had truly said that, it wouldn’t “open the door”. It would have been ruled in Tatis favor and all BLA deals would be void.
@UnrealizedPains@CoachDuggs Is that what they said in the lawsuit? Interesting that his lawyers would publicly announce his accountants misrepresented the income on his tax return.
@UnrealizedPains@jetthedog0003@CoachDuggs It’s an equity investment but the income source is/will be ordinary income. The IRS might say the 2m should be picked up as ordinary income right away and the 2m equity returned isn’t income for Tatis later. Or they can accept that it’s an equity investment and only income later.
@UnrealizedPains@jetthedog0003@CoachDuggs No, it’s an equity investment the minute they signed the deal. It is not, and never was, a convertible note. Tatis was at no point responsible for the 2M in terms of a loan. And he never owed any interest. He only owed them 10% of future MLB contracts.
@jetthedog0003@UnrealizedPains@CoachDuggs No. The case here is an investment, and like all investments, there was a risk for BLA. With Tatis they made a lot of money, with other players they lose money. It’s investments, not loans.
