Do you believe that the votes of the approximately 2.5 million Kashmiris in the territorial constituencies of AJK can extinguish the constitutional voting and representation rights of the approximately 2-3 million (figure quoted by AJ&K Government in the SC Reference) Kashmiris in the 12 non-territorial refugee constituencies, recognised by both the AJK Constitution and the Government of Pakistan?
Items 2(xii) and 4 of the 4 October Agreement ignore the right of audience and constitutional status of these refugee constituencies.
Your position appears to depart from Pakistan's obligations under the UNCIP framework and from the constitutional compass provided by Article 257 of Pakistan's Constitution.
It also marks a departure from the Kashmir policy associated with Z.A. Bhutto, Nusrat Bhutto and Benazir Bhutto.
JKCHR respectfully urges you to revisit your statement. Azad Kashmir is not a Lilliput, and Kashmiris are not a subordinate people. They are people of LEGEND.
Their right to representation in the Assembly cannot be diminished by constitutional engineering or political expediency.

حکومت پاکستان کے نمائندوں، حکومت آزاد کشمیر کے نمائندوں اور آزاد کشمیر کی انتظامیہ میں موجود کراچی ایگریمنٹ اور یو این ٹمپلیٹ کے تحت موجود سول اور ملٹری کمپوننٹ نے بھی کام چلاو اصول کے تحت اپنی input یا تو کمزور اور سطحی دی یا پہلو تہی کی۔ ایک تقسیم پیدا ہوئی ہے۔ جو یہاں زیر بحث لانا مناسب بھی نہیں اور مقصد بھی نہیں۔

پر یہ راہنمائی 5 اکتوبر 2025 کو ہی حاصل کی جا سکتی تھی۔ ایسا اس لئے نہیں ہوا یہ لوگ non Territorial Constituencies میں رہنے والے displaced اور disenfranchised 25 لاکھ سے زائد مجبور لوگ تھے۔
ان پر لین دین اور سیاست کرنی آسان تھا۔
اب ہم مشکلات کا سامنا کر رہے ہیں۔ سپریم کورٹ کی رائے کے بعد ایکشن کمیٹی کے ذمہ داران کو عوامی مفاد میں step back کرکے معاہدے پر عملدرآمد کےلئے اپنی سٹریٹجی تبدیل کرنی چاہے۔
زندگیوں کا ضیاع قابل افسوس ہے۔ اور ایک جان کا ضیاع حق خودارادیت کا قتل ہے۔ ہمارے لوگ راولا کوٹ، کوٹلی اور دوسرے شہروں میں جمع ہیں۔ قانون نافذ کرنے والی ایجنسیز بھی جمع ہیں۔ ایک آٹے بجلی کی تحریک مارا ماری تک پہنچ گئی ہے۔ ہم اس وقت اس کے ذمہ داروں کی نشاندہی کرنا نہیں چاہتے۔ لیکن ان کی نشاندہی اور احتساب بہت ضروری ہے۔
ہمارا صدر اور وزیراعظم ہمارے ووٹ سے نہیں بلکہ پرچی سے نکالے جاتے ہیں۔ ان کو تو پاکستان کی UNCIP Resolutions, کے تحت ذمہداریوں کی تائید ہونی چاہئے تھی۔ بات پرچی تک آپہنچی ہے۔

ہندوستان، بھارتی زیر کنٹرول جموں کشمیر اور دوسری جگہوں سے آوازیں اٹھ رہی ہیں۔ آزاد کشمیر حکومت اور یہاں کی انتظامیہ میں موجود سول اور ملٹری کمپوننٹ ناکام ہو چکے ہیں۔
اب دیر کرنے کی ضرورت نہیں۔ طاقت کے استعمال کے بغیر اس معاملے پر غور کرنے اور بہتری لانے کی اشد ضرورت ہے۔ اب آزاد کشمیر کی سیاست اور حکومت کے چہرے سے نقاب آٹھ چکا ہے۔ میر واعظ عمر فاروق, محبوبہ مفتی، فاروق عبداللہ اور دوسرے لوگ بول پڑے ہیں۔
یہاں تک کہ برطانوی پارلیمنٹ کے 60 ارکان پارلیمنٹ بھی بھول اٹھے۔
آپ ریاست پاکستان کے دو ذمہ دار مناصب کی دو بڑی شخصیات ہیں۔ یہ لمحہ آزمائش ہے اور اس وقت آپ کا تاریخی رول ہے۔
آپ آزاد کشمیر کے Lilliputian ,سیاسی ماحول سے باہر نکلیں اور سرکاری سیاستدانوں اور سرکاری کشمیریوں کے input ,کے ساتھ ساتھ آزاد اور قابل اعتبار input اور سرکاری، غیر سرکاری کشمیری ایکسپرٹس اور ایلڈرز کے ساتھ مشاورت سے اس آگ کو بھجائیں۔
ایکشن کمیٹی کی بنیاد اور طاقت کشمیری عوام کا بھروسہ ہے۔ وہ اس کے تابع ہیں۔ یہ عوامی اعتبار، ریاست پاکستان، اداروں اور پاکستانی عوام کے ساتھ فساد اور لڑائی کے لئے نہیں۔
انہیں پبلک پلیٹ فارم بھی 4 اکتوبر 2025 کے معاہدے کی رو سے استعمال کرنا ہے۔ اس سے تجاوز یا اس کی خلاف ورزی میں انہیں عوام کی تائید حاصل نہیں ہوگی۔
عام آدمی کا تعلق مسائل کے حل اور ایکشن کمیٹی کے قائدین کی ڈائیلاگ کی صلاحیت اور معاہدے کی زبان سمجھنے کے ساتھ ہے۔ ان کی تقاریر کے مقابلے اور ایجنڈا سے ہٹ کر کسی فلسفے کے ساتھ ہر گز نہیں۔
اگر مسائل کا حل عوامی احتجاج اور جانیں ہی قربان کرنی ہیں، تو پھر عوامی ایکشن کمیٹی کی کیا ضرورت ہے؟
لیکن higher burden of responsibility حکومت پاکستان اور حکومت آزاد کشمیر پر ہے۔

Why are there 12 Refugee Seats?
The 12 refugee seats exist because the Azad Jammu and Kashmir Legislative Assembly is not merely a territorial legislature.
It is also a representative institution of a part of the people of the former Princely State of Jammu and Kashmir pending the final settlement of the dispute.
The Assembly therefore represents two constitutionally recognised constituencies:
33 territorial constituencies within Azad Jammu and Kashmir; and
12 non-territorial constituencies comprising State Subjects of Jammu and Kashmir who were displaced and are settled in Pakistan.
The distinction is geographical, not constitutional. Both derive their legitimacy from the same constitutional source.
The Right to Vote in a Plebiscite Does Not Replace Present Representation
The argument that refugees will vote in a future plebiscite misunderstands the nature of the two rights.
A plebiscite is:
a one-time act of self-determination determining the future status of the State.
Membership of the Legislative Assembly concerns:
continuing political representation;
participation in legislation;
accountability of government;
protection of community interests;
scrutiny of executive action.
These are entirely different constitutional functions.
Having the right to vote in a future plebiscite cannot substitute for the right to political representation today.
If that reasoning were accepted, one could equally argue that the 33 territorial constituencies should also cease to have representation until the plebiscite—a conclusion that would be absurd.
Refugees Remain Part of the Political Community.
The refugee constituencies consist of persons who remain:
State Subjects of Jammu and Kashmir;
displaced by the unresolved conflict;
directly affected by any settlement of the dispute.
Their displacement has not extinguished their political identity.
Indeed, one may argue that displacement strengthens rather than weakens the need for constitutional representation.
The Assembly is composed of 45 directly elected members. Thirty-three represent territorial constituencies and twelve represent constitutionally established non-territorial constituencies. Both derive their authority directly from the Constitution. The Constitution makes no distinction in the legislative competence or democratic legitimacy of either category.
Accordingly, abolition of the refugee seats is not merely an electoral reform. It would alter the representative character of the Assembly itself.

The UN framework on Jammu & Kashmir gave the #State of Pakistan — #not individual Pakistani #political parties — a #constitutional and administrative #foothold in Azad Kashmir, subject to #responsibilities assumed under #UNCIP Resolutions and reflected in #Article 257 of the Constitution of Pakistan.
That arrangement was #never intended to convert Azad Kashmir into a #marketplace for partisan competition among Pakistani #political parties. Any premature political rush into Azad Kashmir, #outside the discipline required by the UN framework, #risks damaging the political #temperament, social fabric, and internal #cohesion of the territory, generating dissension and enduring #feuds.
#Reports that Pakistan Peoples Party and Pakistan Muslim League (N)are negotiating political #advantage through the 12 #Refugee Seats representing nearly 2.5 million Kashmiri Refugees in Pakistan raise serious #constitutional and international #concerns.
The #participatory rights, political #identity, and representative #continuity of Kashmiri Refugees cannot be #traded as part of partisan arrangements between Pakistani political parties. Such conduct would #undermine responsibilities assumed under the #UNCIP framework and #offend the spirit of #Article 257 of the Constitution of Pakistan.
Pakistani political parties must #wash their political #linen outside the borders of Azad Kashmir. Their internal #bargains cannot be allowed to #compromise the #dignity, equality, and political #status of displaced Kashmiris.
Kashmiri #Refugees are not a #subordinate category to be #sacrificed for the political #feast of Pakistani parties. Our constitutional and political #relationship is with the #State of Pakistan — represented by the #Government of Pakistan acting within the limits of the UN framework — not with #competing partisan interests seeking #influence in Azad Kashmir.

As one who had the honour of accompanying #Benazir Bhutto at CHOGM-1993 in #Limassol, the Islamic Summit in #Casablanca, and the 50th Anniversary of the United Nations in #New York, and accompanying #Nusrat Bhutto at the UN World Conference on Human Rights in #Vienna, I consider it my duty to #remind the leadership of Pakistan Peoples Party that #elections in Azad Jammu & Kashmir are approaching, including the 12 Non-Territorial #Refugee Constituencies representing nearly 2.5 to 3 million Kashmiri refugees resident in Pakistan.
I was also placed #first among the 13 persons nominated by PPP leadership under Asif Ali Zardari on 12 April 2008 to receive the #Tipperary International Peace Award conferred posthumously upon #Shaheed Mohtarma Benazir Bhutto in Tipperary, #Ireland on 25 April 2008.
These 12 #Refugee Seats are neither an artificial arrangement nor a later political concession. Their constitutional #legitimacy is #rooted in the very formation of the Azad Government of the State of Jammu & Kashmir on 24 October 1947. Refugee and displaced State Subjects were present at the #birth of the Azad Government and constituted a central element of its #representative character.
The Provisional Government of 24 October 1947 never claimed to represent only territory under physical control. It asserted representation of the entire State of Jammu & Kashmir pending a final settlement under international auspices. The Refugee Constituencies therefore preserve the “Whole State” #doctrine and the constitutional continuity of the Kashmir cause.
The #political jurisprudence and international advocacy of #Zulfikar Ali Bhutto, #Nusrat Bhutto and #Benazir Bhutto remained inseparable from the Kashmir cause. The people of Jammu & Kashmir have historically stood with PPP leadership during the most difficult periods and defended its democratic mandate at #national and international forums.
I therefore #sincerely advise the PPP #Parliamentary Board and #leadership to remain fully mindful of the constitutional, historical and international significance of the 12 Refugee Constituencies, and to nominate candidates possessing a #serious understanding of the Kashmir #dispute, State Subject #identity, UN #commitments, and the political history and representative #foundations of Azad Jammu & Kashmir.

Engineer Rashid, #MP from Baramulla, is presently in Tihar Jail. He has been permitted to participate in parliamentary proceedings—affirming his continuing public representative status despite custody.
His father is now critically ill and reportedly on his death bed in Srinagar.
Under established principles of penal jurisprudence and prison administration, #humanitarian parole and temporary release are recognized mechanisms where:
there is a grave family #medical emergency, and
continued detention would cause irreversible personal hardship, without undermining custody or investigation.
Indian courts have repeatedly affirmed that “prisoners do not cease to be human beings” and retain limited but enforceable rights under Article 21 of the Constitution, particularly the right to dignity and humane treatment (principles reflected in Sunil Batra v. Delhi Administration and related jurisprudence).
Internationally, the #United Nations Standard Minimum Rules for the #Treatment of Prisoners (Nelson Mandela Rules) emphasize that imprisonment must not entail unnecessary suffering beyond deprivation of liberty.
In such an exceptional humanitarian situation, grant of parole or protected custody #escort to Srinagar would be consistent with both legal precedent and basic principles of humane justice.
As Nelson Mandela cautioned, the moral strength of law is tested in how it responds to human vulnerability.

The Jammu and Kashmir Council for Human Rights (JKCHR), together with its associate NGOs and civil society partners, #joins in the request submitted by the Islamic Republic of #Iran, the People’s Republic of #China, and the Republic of #Cuba, urging the President of the Human Rights Council to convene an #urgent debate during the ongoing #61st session.
The requested debate concerns the “Protection of Children and Educational Institutions in International Armed Conflicts,” with specific reference to the aerial attack on Shajareh Tayyebeh #Girls School in Minab, Iran, as a grave breach of international law and international human rights.
JKCHR mourns the victims and unequivocally condemns the attack on the Minab school, which reportedly claimed the lives of 168 children between the ages of 7 and 12.
An attack on a functioning educational institution is not only a violation against civilians but a profound affront to humanity itself—an act #rarely witnessed in its severity. The deliberate targeting of children can never be justified and does not confer strength or legitimacy upon any nation.
JKCHR respectfully supports the call made by the Islamic Republic of Iran, the People’s Republic of China, and the Republic of Cuba, and joins in urging H.E. Mr. Sidharto Reza Suryodipuro, President of the Human Rights Council, to convene an urgent debate on the protection of children and educational institutions in situations of international armed conflict.

Over 50 students from Jammu and Kashmir (particularly the Valley) studying https://t.co/HKfZlfHhJ6 Nursing at Mewar University, Chittorgarh, Rajasthan, are facing a #serious problem.
The university #degree they are pursuing is reportedly not #recognised. Students were assured earlier that recognition would soon be secured, but they are now in the #5th semester and the promised recognition has not materialised.
When the students #peacefully protested and sought the attention of the university administration to honour its commitment, over 17 students were #detained by police. Disturbingly, the detained students have reported #inhumane and #degrading treatment at the police station, including being asked to #clean toilets and washrooms. These are guest students from Kashmir and deserve #safety and #dignity.
The #distress has been so severe that three students reportedly attempted #suicide.
Your kind intervention is requested to ensure:
• #The safety and dignity of the students
• #Immediate review of the degree recognition issue
• #Fair treatment and dialogue with the students
An educational institution must look beyond #profit and protect the future of 50 young students who came to Rajasthan in good faith to pursue their education.

We welcome the grant of bail to #Shabir Ahmad Shah by the Supreme Court and his return to his family in Kashmir. We hope that other Kashmiri leaders who continue to #await relief will also be granted bail and allowed to reunite with their families on the #occasion of Eid.
The Indian State bears a #higher burden of responsibility in Kashmir. It has pledged to protect the life, property, and honour of the people, and remains a custodian of their #unfettered right of choice.
#The United States — a global leader in politics and military power, and one of the principal architects of the United Nations Charter — has unfortunately erred in resorting to war and pursuing the idea of regime change in Iran. Such actions risk undermining the very principles of international order that the United States #helped establish.
In seeking outcomes through force, it has not advanced its declared interests and has inadvertently #weakened its moral standing.
Iran’s resilience, however, should not be underestimated. For more than #five millennia of civilizational continuity, #Iran has never been colonised in the manner experienced by many nations.
This depth of history stands in striking contrast to the relatively recent 250 years of #independence of the United States. Iran’s strength lies not only in its institutions but in the enduring consciousness of a civilization shaped by centuries of cultural and political endurance.
The tragic and unlawful death of Syed Ali Khomeini has stirred deep emotion among peace-loving people across regions — from #Qum to #Kashmir, from #London to #Lucknow, and far beyond.
Iran is not an artificial construct or a temporary political arrangement; it is an ancient civilization sustained by a people whose historical memory draws inspiration from the sacrifice of Imam Hussain and the moral milestones associated with his legacy.
In comparison, the perceived strength of Israel is often overstated. Stability in the region cannot emerge through military escalation or territorial expansion, as recent events in #Gaza have painfully illustrated.
Iran presents a very ##different reality — geographically vast, historically deep, and socially cohesive — one that cannot be easily subdued or reshaped through external pressure.
The countries of the #Gulf, whose proximity gives them both stake and responsibility, might have played a more constructive role in urging restraint upon both #Washington and #Tel Aviv.
Preventing escalation could have helped preserve regional stability and avoided the possibility that prolonged conflict may eventually destabilize the very political structures of the region.
At this moment, voices across the world — #individuals, #civil society organisations, and #governments — should use their influence to urge the United States to bring an #end to this war. Military power, however formidable, loses its moral legitimacy when it is unleashed against civilians or across sovereign borders.
We wish the people of Israel peace and security within their internationally recognised borders. Yet peace cannot be built through cycles of violence or territorial expansion. Iran represents a different challenge altogether — one defined by scale, history, and identity. Across centuries it has endured, and its civilization has enriched the wider world.
Those who believe in peace, and who hope to leave a better future for their children and grandchildren, should listen carefully to the sentiments rising from Qum to Kashmir, from London to Lucknow.
The strength of a nation is ultimately measured not by the force it commands, but by the resilience of its people and the justice of its #cause.#US_IRANWAR

In May 1987, at an International Conference in Dubrovnik (former Yugoslavia), I raised the issue of #Abuse of Power in Jammu & Kashmir. Despite relentless pressure from Indian delegation, #Kashmir co-chaired a session alongside China and Finland after a Committee ruled in its favour.
On 10 January 1990, JKCHR reported by telegram the first #killings of 8/9 January in Srinagar by Indian Security Forces. On 23 January, the UN informed us its sources, including Amnesty International, could not corroborate the report.
We responded firmly: non-corroboration does not render a report #unfounded, nor does it disqualify it as evidence.
On 4 April 1990, the UN invited JKCHR to Geneva. On 6 July 1990, we met senior #UN officials at the Palais des Nations and discussed a 13-point agenda.
Since then, I have remained engaged in defending human rights — in Jammu & Kashmir, East Timor, Gaza/Palestine and elsewhere. I served on #IPJET until East Timor’s independence and later represented asylum seekers in London (UKIAS) before #resigning when events in Indian-administered Kashmir demanded full attention.
I have witnessed #grievous human suffering across regions. I have always held myself steady.
Except today.
Media reports state that #Imran Khan — former PM of Pakistan, philanthropist, and founder of major hospitals and educational institutions — has allegedly been denied proper #medical care for his eye in Adiala Jail since November 2025, resulting in loss of vision in his #right eye.
If true, this is deeply #troubling.
A prisoner’s repeated calls for medical care must never be ignored. #Denial of treatment is not strength — it is #failure of #duty and humanity.
History judges nations not by how they treat allies, but by how they #treat opponents.
My sympathies to #Imran Khan, his #family, and his legal #team.
I met him only #once — over #tea — when he sought my advice on Kashmir, long before he became Prime Minister. All at JKCHR #pray for his health and #wellbeing.

1. G M Shah was people's man.
2. He braved the attack launched by one NC and one BJP MP in the Parliament on his interest in regularising my stay in Kashmir.
3. He was humble and easily accessible.

G M Shah was a person of great qualities and noble elements. His humaneness always remained exemplary and overwhelming.
A people’s man. Honourably and proudly served the "People of Legend. "
He left great impact and influence on my understanding of human rights, when he defended my right to travel and family union in 1985.
He did not yield to pressure brought on him in the Parliament by NC and BJP members of Parliament, for defending my visit.
A great human being. May Allah bless his noble soul in heaven. Shah sahib left this world on 6 January 2009.
