MEN EXCLUDED FROM PR ELECTION TO PROVINCIAL & METROPOLITAN COUNCILS
In terms of Constitution of Zimbabwe Amendment Act, Number 2 enacted in 2021, which repealed sections 268 and 269 of the 2013 Constitution, and substituted them with a new section 268, men are excluded from participating in the election by proportional representation of 10 members of the provincial or metropolitan council.
Section 268(1) of the Constitution, as amended, provides that:
“There is a provincial council for each province and metropolitan council for each metropolitan province, consisting of:
(a) a chairperson of the council, elected in terms of section 272; and
(b) the mayors and chairpersons, by whatever title they are called, of all urban and rural local authorities in the province concerned; and
(c) ten women elected by a system of proportional representation referred to in subsection (3).
Section 268(2) of the Constitution, as amended, provides that:
“A woman is qualified to be elected to a provincial or metropolitan council in terms of subsection (1)(c) if she is qualified for election as a Member of the National Assembly”.
While section 268(3), as amended, stipulates that:
“Elections to provincial and metropolitan councils must be conducted in accordance with the Electoral Law, which must ensure that the women referred to in subsection (1)(c) are elected under a partylist system of proportional representation—
(a) which is based on the votes cast for candidates representing political parties in the province concerned in the general election for Members of the National Assembly; and
(b) in which women with disabilities are included”.
And, regarding vacancies that may occur in the provincial or metropolitan councils, section 268(4) of the Constitution, as amended, provides that:
“The seat of a member of a provincial or metropolitan council referred to in—
(a) paragraph (b) of subsection (1) becomes vacant if the member ceases to be a mayor or chairperson of a local authority in the province concerned;
(b) paragraph (c) of subsection (1) becomes vacant in the circumstances set out in section 129, as if the member were a Member of Parliament”.
While @ZECzim has been crystal clear in its public communication that the 10 members of the provincial or metropolitan councils to be elected by proportional representation on a partylist must be “women only”, political parties seem to have either overlooked this key constitutional provision or they have decided to ignore it, wrongly believing that “the zebra system” [a list of a mixture of an equal number of women and men, with women on top of the list] used in the election of the 60 senators [six per province] will be used.
For example, in his letter to all provinces dated 14 June 2023, ZanuPF’s National Political Commissar, Dr Michael Chakanaka Bimha, wrote that:
“Each Province is required to elect ten (10) candidates, five (5) female and five (5) male”.
But the Constitution of Zimbabwe, as amended in 2021, does not have such a requirement, instead, it is very clear that only ten (10) women should be on the partylist for election by proportional representation to the provincial or metropolitan council.
Meanwhile, there's talk or confusion as to whether the new position in the Constitution, as amended in 2021, was intentional, or a drafting mistake, or a typo or even an act of God.
There’s also the fact that the organic or inherent pillars of the Constitution of Zimbabwe are against gender discrimination, yet section 268 of the Constitution, as amended, discriminates against men with regards to the election of members of the provincial or metropolitan council by proportional representation.
Clearly, there’s an urgent issue that requires either attention or clarification or understanding or all these things and more, keeping in mind that the Constitution is the primary and supreme law of the land, whose amendment involves a long and involved process of law making.
Because the provision that the 10 members of the provincial or metropolitan council elected by proportional representation must be women only is in the Constitution itself, it means that "the anomaly" would not have been "corrected" by or under the Electoral Amendment Act that Parliament failed to pass before the gazetting of the election proclamation on 31 May 2023. What should be "corrected", if need be, is the Constitution, through an amendment.

I STAND BY MY KUDOS TO FINANCE MINISTER PROF NCUBE FOR THE ECONOMIC STABILISATION MEASURES HE ANNOUNCED IN MAY
Today’s @HeraldZimbabwe reports that, “retailers have started recalibrating prices in line with the prevailing official exchange rate following its liberalisation, which forms part of broad measures to clamp down on pricing madness and restore stability in the economy.
The return to proper pricing models by registered businesses, including the country’s largest retailers OK Zimbabwe and Pick ‘n’ Pay, has seen an influx of customers back into the supermarkets and increased the use of foreign currency for purchases as arbitrage from exchange rate premiums narrow.
Price and exchange stability appears to be returning quickly to the market, as stabilisation measures announced by Treasury and the central bank start to take effect.
This comes as the gap between the parallel market rate, largely blamed for driving prices increases and creating distortions in the market, has narrowed significantly over the past few days," #Herald
This is evidence that the economic stabilisation measures announced by Prof Ncube in May were fundamentally sensible, and they deserve support from other stakeholders in government, business, society and the economy.

The Zimbabwean ruling party, ZANUPF is determined to pass the Patriotic Act bill tonight as it rushes to muzzle critics of its corrupt rule before the elections.
The Patriot Act bill seeks to stop the opposition, government critics and journalists from exposing the political elites corruption under the guise of patriotism.
Today Norton Independent Member of Parliament, @TembaMliswa was kicked out of parliament during the Patriotic Act bill debate when he brought up the Gukurahundi genocide.
Many opposition and ZANUPF MPs have sent messages to me telling me that the passing of the draconian Act is imminent, and it could happen tonight!
If the Act is passed and signed into law, anyone who criticizes the President will be jailed.
Anyone who talks to officials of any government including ambassadors will be jailed.
Anyone who gives an interview that is perceived to show the regime in bad light will be jailed.
Zimbabweans will be jailed for telling the truth about their government, and that could become official from tonight if it is passed only waiting for the President’s signature!
