राजस्थान सरकार के वित्त विभाग ने 2 जून को एक आदेश जारी किया गया है जिसमें कि तृतीय श्रेणी अध्यापकों को राज्य सरकार का कर्मचारी ना मानकर नहीं माना गया है और ऐसे जितने भी कर्मचारी अन्य उच्च पदों पर सीधी भर्ती से नियुक्त हुए हैं और पे प्रोटेक्शन का लाभ लिया है उनके वेतन नियतन पुनः कर अधिक भुगतान वसूली के आदेश जारी करने की तैयारी की जा रही है।
इस परिपत्र के अनुसार राज्य के सार्वजनिक उपक्रमों/ स्वायत्तशासी संस्थाओं/ स्थानीय निकायों एवं पंचायतीराज संस्थाओं के कार्मिक राज्य सरकार के कर्मचारी नहीं हैं, अतः ऐसे कार्मिक यदि सीधी भर्ती के माध्यम से राजकीय सेवा में नियुक्त होते हैं तो उन्हें राजस्थान सेवा नियम, 1951 के नियम 24 एवं 26 के अंतर्गत पूर्व पद का वेतन संरक्षण(Pay-protection) देय नहीं होगा।

जिसके आधार पर मुख्य ब्लॉक शिक्षा अधिकारियों द्वारा कार्यालय स्तर पर कमेटियों का गठन करके सेवा-पुस्तिकाओं का भौतिक सत्यापन किया जा रहा है। जिनमें ऐसे कार्मिक जो पूर्व में अध्यापक तृतीय श्रेणी में थे अथवा अन्य विभाग से अध्यापक तृतीय श्रेणी पर नियुक्त हुए, की सेवा-पुस्तिकाओं में वेतन-संरक्षण(Pay-protection) को त्रुटिपूर्ण और नियम विरुद्ध बताया जा रहा है।

ग्रामीण विकास एवं पंचायती राज विभाग के दिनांक 14/3/11 के परिपत्र के प्रारंभिक शिक्षा, स्कूल शिक्षा विभाग के अधीन है एवं तृतीय श्रेणी अध्यापकों की भर्ती प्रक्रिया के अतिरिक्त समस्त सेवा प्रकरण पैतृक विभाग अर्थात स्कूल शिक्षा विभाग द्वारा संपादित किए जाने हैं। अतः जिन अध्यापकों की नियुक्ति जिला परिषद/ पंचायत समिति के माध्यम से तृतीय श्रेणी अध्यापक के रूप में हुई थी तथा वर्तमान में उनका पैतृक विभाग शिक्षा विभाग ही है।
उल्लेखनीय है कि माननीय सर्वोच्च न्यायालय ने भी एक प्रकरण में निर्णय दिया है जिसमें पंचायती राज संस्थानों के सभी कार्मिकों को राज्य सरकार के कार्मिक माना गया है, ऐसी स्थिति में यदि किसी प्रकार की वसूली के आदेश होते हैं तो सारे शिक्षक आंदोलन की राह पर जाएंगे।
आग्रह है इस आदेश को वापस लिया जाए।
