They can still be filed in the ELRC but on behalf of an applicant rather than in public interest. You will note that even in the appeal before the SCOK, the court stated that the petitioners had not filed the petition on behalf of applicants but rather as public interest litigators. Meaning that if they had filed on behalf applicants, the ELRC would have had jurisdiction.

How was the judge supposed to know that there are Court of Appeal orders allowing the sale? It’s likely that the applicant at the high court did not disclose all material facts. Anyway, that’s why it’s always safer to direct a party to serve and come back even if it’s within hours instead of granting a stay ex parte.
