Once again, a court has ruled that an athlete has a protectible right as a third-party beneficiary to the NCAA Manual and Bylaws. "One need only look to the statements in the NCAA Manual, which contains the NCAA's Constitution, to reach the conclusion that Mr. Carsello is an intended third-party beneficiary of that agreement."
The court found that no remedy at law could replace Carsello playing football for Northwestern and that he would experience irreparable harm absent relief.
The Court, importantly, said it did not intend to undermine the NCAA and even referred to it as "an honorable institution." But "with all due respect to the NCAA, the balancing of the equities weighs in Mr. Carsello's favor as the harm to the NCAA is much less than that which would occur to Mr. Carsello."
You can say that this is just another state judge ignoring NCAA policy, but at some point you should recognize that these judges, who have tons of experience, are not simply seeking to obstruct the NCAA. In fact, this judge went as far as to state that he did not want to undermine the NCAA. He just demands that the NCAA follow its own rules. And that's what we keep fighting for across the country.
This will be another case that we use in our challenges to NCAA denials and cancellations of waiver requests.

The NCAA applied an undisclosed categorical policy to cancel a waiver request submitted on behalf of Kashie Natt instead of conducting the individualized review its own bylaws require or engaging with the extensive record of extraordinary circumstances OSU submitted.
We are seeking immediate injunctive relief so Kashie can resume full team activities and compete for OSU during the 2026-27 season.
He withdrew from the 2026 NBA Draft in reasonable reliance on the NCAA’s process. Kashie is entitled to a fair adjudication on the merits.
🚨DEMS PULL UPSET ON EPSTEIN FILES:
🚨MAJOR BREAKING: In a genius move, House Democrats were able to pass a motion in the GOP-controlled House Oversight subcommittee to subpoena ALL the Jeffrey Epstein files.
Republicans were blindsided because Democrats dropped an 11th-hour motion at an unrelated hearing after noticing that most GOP members on the panel had publicly demanded the files be released.
The GOP chair was caught off guard and scrambled—first delaying the vote, then trying to sabotage it by adding amendments to include Biden administration communications. Democrats called their bluff and agreed.
Then the GOP chair, Rep. Higgins, lied, claiming the motion FAILED until Rep. Robert Garcia forced a full roll call vote.
Ultimately, the vote passed 8-2 after 3 Republicans DEFIED their leadership and joined all 5 Democrats to pass the motion.
