@haskell@Hosselote@NACEsports No one calls football programs in the SEC gate keepers for wanting to play other schools with similar funding and support. There’s no ego, but a club is not the same as a program, regardless of talent. Clubs should get their universities to give them the support them like Boise.
@Little_B_Man Everyone that’s mad at PlayVS, should be equally if not more mad at publishers for agreeing to the exclusivity. PlayVS is simply exercising the rights the publisher agreed to give them.
@MrDahle @ObiWanNICKobi @jimohagan I empathize with you and everyone else, any roadblock for students is a step backwards. Exclusivity Contracts implies two parties agree. If you haven’t heard from the other party, then how do you know if it’s exclusive, or violates guidelines? Would be curious what a lawyer says
@ObiWanNICKobi @MrDahle @jimohagan If the distributor is claiming they have exclusivity but the IP owner doesn’t validate those claims through their enforcement efforts, then everyone just received letter that doesn’t mean anything. IMO
@ObiWanNICKobi @MrDahle @jimohagan This is totally my google law degree speaking, so take it with a grain of salt. The IP owner has the obligation to validate exclusivity through enforcement of the agreement they made with the exclusive distributor.
@ObiWanNICKobi @MrDahle @jimohagan If they fail to enforce, then it’s a breach of said exclusivity agreement, and that’s where the legal battle between the two parties should be over the legally binding agreement.
@ObiWanNICKobi @MrDahle @jimohagan I’m just posing the question. Ultimately it seems like the publishers have the power to dictate with who and how their IP is used. If that’s the case, I’m not sure anyone but the publishers can solve the problem educators are facing.
