I find it neccessary to let CJ Martha Koome know that advocates are very frustrated with the state of affairs in the Judiciary. If nothing is done, very soon advocates will protest and boycott courts calling for the CJ to resign. Not even LSK will stop them. Advocates are tired.

There is a disturbing trend of young lawyers trying to be concise.

A 2nd-year drafted an executive summary for a banking client using bullet points and plain English.

She proudly stated that she reduced a 50-page compliance memo into a 2-page brief.

I asked her if she thought the client was paying $950 an hour for brevity.

She muttered something about respecting the CEO's time.

I explained that clients don't pay us to solve their problems quickly.

They pay us to make their problems look so incomprehensible that only we can solve them.

I made her rewrite the summary using dense, impenetrable legalese.

It took her 12 hours to bury the conclusion on page 42.

The client called me the next morning to thank us for our incredibly thorough analysis.

Clarity is a customer service concept.

We are in the business of intellectual intimidation.

We must all be gravely concerned about this Tuju situation. You may say it’s a private matter but what you need to understand is that it’s a continuation of the “mambo ni matatu” way of solving private commercial disputes. See it in the context of Rai, and the deported Chinese businessmen over a 30B shilling tender. We have a rogue regime that deploys dark arts to force outcomes in commercial disputes. No investor would put their money into such a country. It’s why the private sector is fleeing Kenya, it’s why our young people have no jobs. It’s why we keep insisting on the values of our constitution. It’s why we sing Rule of Law. It’s not about shiny things people. The state, whose job it is to protect citizens must now produce Tuju!
