The President and the Secretary of the Interior are now publicly pressuring the Justice Department over its decision to drop the charges against Davey Hearn. These comments should concern everyone.
Today, President Trump said U.S. Attorney Jeanine Pirro “made a mistake,” insisted “it was vandalism,” and said she “folded like an umbrella.” Secretary Burgum also doubled down, claiming “the evidence is clear” and that vandals “repeatedly caused damage to the Reflecting Pool.”
However, citing evidence, the Justice Department’s own court filing says it is “difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone to establish that fact beyond a reasonable doubt.” The DOJ also acknowledged the damage resulted from flawed installation by the contractor. A criminal prosecution should be guided by facts, evidence, and law, not by public pressure from the President or Cabinet officials angry that the facts do not fit their narrative.
Davey Hearn should NEVER have been made the face of a failed renovation project.
We stood with Davey. And we still do.
Incredibly, the President just made a statement disagreeing "100%" with the dropping of charges against Davey Hearn and *still* trying to call the Reflecting Pool failure "a pure case of VANDALISM"!
However, his own Justice Department dropped the charges against Davey Hearn last night because the evidence *did not* support attributing the Reflecting Pool damage to vandalism! And that is the point... Government power should be guided by facts, evidence, and law, not by a political narrative that collapses under scrutiny even before a trial.

The charges against Davey Hearn have been dropped! After weeks of trying to portray Davey as a vandal who maliciously damaged the Lincoln Memorial Reflecting Pool, the Justice Department has now acknowledged what so many of us have been saying from the beginning: the evidence did not support their story!
In its court filing this evening, the government stated that “it is difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone to establish that fact beyond a reasonable doubt.” The filing also states that the damage was, in fact, “the result of flawed installation by the contractor.”
The federal government also revealed that the sealant at the bottom of the Reflecting Pool had “[a]lmost immediately” begun peeling after the work was completed by the Virginia-based company that received the no-bid contract for the renovations.
Davey Hearn should NEVER have been made the face of this failure. Davey is a U.S. Olympian, World Champion, coach, volunteer, and someone who has spent his life representing our country, caring for public spaces, mentoring athletes, and giving back to the community. The government owes Davey an apology!
Thank you to everyone who stood with Davey, came to court, shared the facts, spoke up, and refused to let the government’s narrative go unanswered. This is a reminder that facts matter. Evidence matters. Fairness matters. And when government power is used without proportionality and common sense, people have a responsibility to speak up.
We stood with Davey, and finally... Davey has been vindicated!
