@ERBrandt@MarkEHartman I agree with Emily. And, for the record, I have seen plenty of “chosen” attorneys also fail to object/adequately preserve an issue.
@CorrineGunning After seeing your post, I bought the audio book. The line that is stuck in my mind so far is about the hard work involved in “getting it right” in this system “and, even when right, is still deeply wrong, because all it can do is punish” (moral injury in a phrase)
@CorrineGunning Yesterday the Senate Judiciary contingent offered a “crime bill” bundle and one was an unprecedented registration obligation. Guess they didn’t get the memo that registration is a “civil regulatory scheme” or maybe they are just being honest (because this is undeniably punitive)
@ERBrandt For the longest time, I copied my dad and answered, “Jennifer Roth speaking” which, in retrospect, sounds unhinged. Now I just say “this is Jennifer”
Fun fact: Of the 14 cases being argued this week at the Kansas Supreme Court, 9 are being argued by public defenders. #NoJusticeWithoutUs#FundPublicDefense
appellate defender extraordinaire Michelle won the Excellence in Written Advocacy award. it is such a privilege to learn from Michelle!
her writing is concise and persuasive. she tells her clients' stories and educates the appellate courts through her written and oral advocacy.
Came across this photo from 2013. This scarlet phone was (maybe still is?) in the lobby of the Shawnee County Sheriff’s Dept. for people to check in for their offender registration appointments.
Yet KORA isn’t punishment,
just a "civil regulatory scheme"
1/ I recently interviewed @RachelBarkow re her new book Justice Abandoned:
How the Supreme Court Ignored the Constitution and Enabled Mass Incarceration. Her thesis is provocative yet simple: mass incarceration could only be achieved by systematically violating the Constitution.
The Kansas Court of Appeals traveled across the state today to listen to a total of eight hearings. Thank you to @pittstate, @emporiastate, @JCCCtweet, and @FortHaysState for welcoming us to your campuses. More photos will be posted soon.

Also, a very BIG THANK YOU to all the KSLEG Revisors, LEG Research, Post Audit, Office Assistants and others who make the KS Capital work. Much Appreciated!!! #ksleg#kscourts
🚨🚨According to a new study, a dire shortage of public defense providers threatens the 6th Amendment rights of people in Kansas, jeopardizing the basic functioning of the state’s justice system.

@ERBrandt And it wouldn’t be a hearing about registration without a heart rate alert (I couldn’t take a picture of it fast enough, but here’s what it was…and I had been sitting for 20 minutes)
💯
Big thanks to Sen. Warren for having the first order of business in Senate Judiciary be an update by @heathercessnapd. And I can’t overstate what it means to me to hear Heather being brutally honest (to borrow a phrase from the BIDS budget narrative) about the crisis we face.
The Legislature faces a key budget decision on funding constitutionally required attorneys for felony defendants who can’t afford them. The most economical way to provide constitutionally adequate attorneys is with good full-time public defenders. https://t.co/MwVhAn70fr
